HomeMy WebLinkAboutOrdinance No. 19242ORDINANCE NO. 19242 AN ORDINANCE CONCERNING PARKING; AMENDING SECTIONS 5.01D, 5.285 AND 5,540 O F THE EUGENE CODE, 1971; ADDING A NEW SECTION 5.24D TO THAT CODE; AND PROVIDING AN EFFECTIVE DATE. THE CITY CF EUGENE DOES ORDAIN A5 FOLLOWS: Section 1. Section 5.010 of the Eugene Code, 1971, is hereby amended by adding in alphabetical order therein the following: 5.010 Parkin facility. Any real property, or any building or a portion thereof, privately or publicly owned, which has been '~ ~ marked with designated parking spaces for motor vehicles, or any real property which has not been marked with designated parking spaces for motor vehicles which by function, custom or usage would cause a reasonable person to believe it is used for parking motor vehicles. "Parking facility" does not include: ~a} Property within a public way, fib} Property where parking is normally not permitted at all , ~c} Property primarily used far residential purposes where there ~ s deli grated par~ki ng far not more than 1O vehicles, or ~d} An off-street parking lot or structure of another public agency unless the city has contracted with that public agency to enforce the parking regulations at that site. Section 2. There is hereby added to the Eugene Code, 1971, a new sec- tion to be numbered and provide: 5.240 Prohibited Parki n ~ Of f-Street Facilities . ~1} Except to momentarily pick up or discharge a passer er, no person shall stand or ark a e g' p v hhcle on private or public property ~n a marked emergency vehicle lane, ~2} This subsection does not apply to property within the ublic way or to an emer enc vehicle arke p 9 Y p d while its operator performs official duties. Except to momentarily pick up or discharge a passenger, or exce t p with permission of the owner or person in lawful possession of the remises no person shall stand or ark a p . p vehicle or al l ow a vehicle to stand or park ~n a manner or location that impedes the orderly movement of vehicle or pedestrian traffic on such premises. ~3} Except for an emergency vehicle parked while its o erator performs official duties no a p• • ~ p rson shat 1 parka veh~ c1 e ~ n a parks ng facility in violation of signs pasted as provided in section 5.540 1 of • ~} this code which have been approved under subsections 5.5402} or 5.540 3 ~} Ordinance - 1 ~9 zy~ of this code and contain additional words that unauthorized vehicles may be cited for violation of this subsection. Section 3. The first paragraph of subsection ~5~ of Section 5.285 of the Eugene Code, 1971, is hereby amended to read and provide: 5.285 ~5} Except for the airport as defined in section 2.415 of this code, the following minimum and maximum charges are hereby established for off-street parking facilities provided by the city to be effective January 1st of the year designated unless otherwise expressly provided. The charges fora specific facility or part thereof to be established by admin- istrative action of the city manager except he may not establish the charges for parking facilities within the Downtown Development District without first receiving the recommendation of the Downtown Commission. Section 4. Section 5.540 of the Eugene Code, 1971, is hereby amended to read and provide: 5.540 Si ns Re uired for Parkin Facilities Before Citin or Towin Unauthorized llehi cl es . ~1~ 1~hen required by this code or state law a parking facility shall have notice of parking restrictions posted in at least one of the following ways: ta} A sign at each entrance in plain view to any person entering the facility in a motor vehicle which: 1. Is not more than 10 square feet nor less than 3 square feet in size; 2. Contains lettering readable fora distance of 50 feet stating: a. who is authorized to use the parking facility, b. That unauthorized vehicles will be cited for violation of section 5.240 of this code or will be towed away at the vehicle owner's expense, and c. The hours when unauthorized vehicles may be cited or towed; or ~b~ Signs within the parking facility of the same size and content as prescribed in paragraph ~a) of this subsection which are readable from each parking space; or ~ c~ At each designated parking space an individual sign of not less than one square foot nor more than three square feet in size containing the notice prescribed in paragraph ~a~2. of this subsection. ~2~ The city manager or his or her designee shall rescribe stan- . p. Bard signs with wording that meets the requirements of subsection ~1} of this section. Existing signs which do not meet the sign design approved by the city manager shall be replaced with signs of the approved design no later that July 1, 1985. ~3} Upon written approval of the city manager or his or her designee, the size of the signs and 1 etteri ng required by this section may be modified provided the modification gives reasonable notice to vehicle operators seeking a place to park.
