AN ORDINANCE CONCERNING MUNICIPAL COURT; AMENDING
SECTIONS 2.175 AND 2.1990 DF THE EUGENE CODE;
1971; ADDING SECTIONS 2.811 AND 2.1995 TO THAT
CODE; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLD~S:
Section 1. Section 2.775 of the Eugene Code, 1911, is hereby amended
to read and provide:
2.775 Munici al Court - Authority. The municipal judge shall have all
. inherent statutory powers and duties of a justice of the peace

Section 2. There is hereby added to the Eugene Code, 1971, a new sec-
tion, to be numbered and provide:
2.811 Munici a1 Court -~ Disre and of Bury Notice. The munici a1 jud e

may hold a prospective juror who disregards the notice of jury
duty in contempt of court.
Section 3. Section 2.1990 of the Eugene Code, 1971, is hereby amended
by deleting subsection (2) therefrom, renumbering the present subsections
(3), (4), (5), and (6) to (6), (2), (4), and (5) respectively, and adding a
new subsection (3) thereto, to read and provide:
2.1990 Penalties -- S ecific.
~1} Violation of sections 2.402 to 2.412 and 2.988 is unishable
by a fine not to exceed 500 or p

or both fine and imprisonment; in addition, the city attorney, upon re uest

enforce the provisions of sections 2.402 to 2.412 and 2.988 of this Code.
~2} Violation of a rule of the department of parks and recreation
adopted under section 2.$12 et sec. is punishable by a fine not to exceed
$500 or confinement in jail not to exceed 30 days, or both such fine and
imprisonment.
~3} A person found in contempt of court under section 2.811 ma
be punished by fine not to exceed y
$100 or confinement in.jail riot to exceed
20 days or both fine and imprisonment.
~4} A violation punishable under section 2.10783}~a is unish-

able by a fine not to exceed $500 for each unit with respect to which the
violation has occurred. Each day during which any unit has been advertised
or offered or sold and such advertisement or offer or sale has not been
withdrawn shall constitute a separate offense. The city attorney's office
may apply to any court of competent jurisdiction to enjoin a conversion
without a permit found to exist by the city.

~5~ A violation punishable under section 2.10783}fib} is punish-
able by a fire not to exceed $500 for each day of continuing violation.
~6} Violation of sectian 2.890 is punishable by a fine of not
more than $100 for each day the violation exists; in addition, the city
attorney, upon request of the city manager, shall institute any necessary
civil proceedings to enforce the provisions of sections 2.876 to Z.H96 of
this Code.
Section 4, There is hereby added to the Eugene Code, 1911, a new
section, to be numbered and provide:
2.1995 Penalties - General. Except as provided in section 2.1990, viola-
tion of any section in this chapter is punishable by a fine not to
exceed $100.
Section 5. That the matters contained herein concern the public welfare
and safety and therefore, an emergency is hereby declared to exist, and this
Grdinance shall become effective immediately upon its passage by the City
Council and .approval by the Mayor.
