HomeMy WebLinkAboutOrdinance No. 19254ORDINANCE N0. ~~~ AN ORDINANCE CONCERNING MERCHANT POLICE; AMENDING SECTIONS 3.005, 3.010, AND 3.314 OF THE EUGENE CDQE, 1971; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLO~IS; Section 1. The definition of "Merchant police agency" as set forth in Section 3.005 of the Eugene Code, 1971, is hereby amended, and anew defini- tion for "Merchant police III" is hereby added in alphabetical order therein, to read and provide. 3.005 Merchant olice a ency. An individual, corporation, associ- ation, firm, ar partnership engaged in the business of watching, guarding, or protecting premises, property or persons, and who employs one or mare Class I, Class II or Class III merchant police, except an on-premise agency. Merchant alice~ III. An individual engaged in the temporary occupation of watching, guarding or protecting premises, property or persons, who does not have firearms, batons, night sticks, chemical spray or any device for the purpose of subduing or physi- cally restraining any individual, and who does not work from a vehicle on public roads while so employed. Temporary work shall not exceed seven days in any thirty day period. Section Z. The table of licensed businesses contained in Section 3.010 of the Eugene Code, 1971, is hereby amended by adding in alphabetical order therein a listing for Merchant Police III, and amending Note 1l thereto, to read and provide: 3.010 Merchant olice III - See Note 17 License fee - $3.00 Note 17 - Merchant alice a ency. Except for merchant police III employees an agency shall pay in addition, the $25.00 application fee and $25.00 annual license fee far each merchant police employed by the agency, together with the $25.00 certification fee provided far in Note 19. An agency shall pay the $3.00 license fee only for each merchant police III employee, and shall further provide that its bond and liability insurance provides coverage for merchant police III employees. Section 3. Subsection ~3~ of Section 3.314 of the Eugene Code, 1911, is hereby amended, subsection ~5~ is renumbered to ~6~, and a new subsection ~9~y ~5~ is hereby added thereto, to read and provide: 3.314 Merchant Police A ency - A lication. ~3} No agency licensee shall employ an individual as a merchant police I, II ar III without submitting an application for licensing of that individual, nor continue to employ an individual whose license has been sus pended or revoked, nor an individual in a capacity other than that for which licensed. ~5~ No agency sha11 employ an individual as a merchant police III without providing to the city at least three business days in advance of the temporary event for which employed, the employes name and date of birth, as well as the license fee for each employe. No application fee shall be required for merchant police III employes. ~6~ An agency licensee shall notify the chief of police and the 1~cens~ng authority of the termination of any employe within ~4 hours of such termination, and shall recover from the employe and return to the licensing authority any certification card or identification card issued to that employe, Section 4. That the matters contained herein affect the public welfare and safety and therefore,~an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
