HomeMy WebLinkAboutAdmin Order 58-93-07 59'-'3 -07 BEFORE THE CITY MANAGER OF THE CITY OF EUGENE In The Matter of Authorizing the Filing of an Application to Impose and Use and Impose Only a Passenger Facility Charge (PFC) at the Mahlon Sweet Airport (Application) and the Imposition of a $3.00 PFC per Enplaned Passenger to Fund Certain Airport Capital Projects and Authorizing Certain Additional Actions in Conjunction with Filing Said Application and Administering the Subject PFC Program ) ) ) ) ) ) ) ) ) ) ) ) ) ) ORDER AUTHORIZING FILING OF APPLICATION TO IMPOSE A P ASSENGER FACILITY CHARGE (PFC), SETTING A PFC RATE, AND AU1HORIZING CERTAIN ADDIDONALACTION The City Manager of the City of Eugene finds as follows: 1. The Federal Aviation Administration (FAA) has issued regulations, pursuant to Congressional legislation, authorizing the imposition of a Passenger Facility Charge (PFC) for enplaning passengers at domestic airports. 2. Eugene Code ~ 2.441 establishes ratemaking procedures for the imposition of any fee, charge or rental for the use of Mahlon Sweet Airport. 3. Pursuant to this authority, procedures were initiated for setting the amount of Passenger Facility Charges to assess enplaning passengers using Mahlon Sweet Airport. A Notice of Intended Charges was sent to interested persons. The Notice of Intended Charges was published as provided by law. 4. Comments and inquiries were received from scheduled passenger carriers. No such carriers or other interested persons asserted that the proposed charge was excessive or unreasonable. No request for a hearing was received. 5. Under the Notice of Intended Charges, the PFC to be charged is $3.00 per enplaning passenger. Exceptions to the PFC are provided by federal regulation. Since the Notice of Intended Charges, there has been no change in the revenue needs of the Airport or the generation of any new data which would affect the investigation set out in the City Manager's investigative file. No objection to the proposed charge, or the exceptions to the charge, have been made. Therefore, based on the record contained in the investigative file and the comments received from interested persons, IT IS HEREBY ORDERED THAT: 1. The findings set out above and contained in the investigative file are adopted. 2. The proposed Passenger Facility Charge (PFC) to enplaning passengers using Mahlon Sweet Airport is APPROVED. 3. The Airport Manager is hereby authorized to file with the FAA a PFC application to impose and use and impose only a PFC of $3.00 per enplaned passenger ( except for those passengers exempt under the application of the regulations) at the Mahlon Sweet Airport, including all understandings and assurances contained therein, to be used for projects included within the Airport's capital plan. 4. The Airport Manager is authorized, upon approval by the FAA, to levy and collect, through air carriers and certain other aircraft operators serving the Mahlon Sweet Airport, a PFC of $3.00 per enplaned passenger beginning November 1, 1993, and continuing through October 31, 1998 or such earlier or later periods of time as approved by the FAA in accordance with the Applications and regulations. 5. The Airport Manager is hereby authorized and directed to file the Application of behalf of the City of Eugene and to otherwise seIVe as the official representative of the City of Eugene to act in connection with the Application and to implement the PFC program at Mahlon Sweet Airport. 6. Copies of this Order shall be mailed to all interested parties and shall be promptly delivered to the Mayor and the City Councilors.
