HomeMy WebLinkAboutAdmin Order 58-94-02-F ADMINISTRATIVE ORDER NO. 58-94-02-F of the City Manager of the City of Eugene ESTABLISHING A FEE FOR SYSTEM DEVELOPMENT APPEALS PURSUANT TO SECTION 7.735 OF THE EUGENE CODE, 1971 The City Manager of the City of Eugene finds as follows: A. Sections 2.020 and 7.735 of the Eugene, Code, 1971 authorizes the City Manager of the City of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits, and specifically the fee for appeals of system development charges. B. In accordance with the procedures set forth therein, on March 4, 1994 I notified the Mayor and City Council that I intended to establish a fee for appeals of system development charges as set forth in the Notice of Intended Fees attached as Exhibit A thereto. The Notice was also posted at two locations at City Hall, and made available for inspection by interested persons at the offices of the City Engineer, 858 Pearl Street, Eugene, Oregon 97401 during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). The Notice provided that written comments would be received thereon for a period of 15 days from the first date of posting. No responses were received within the time or in the manner required by the Notice. C. I find that an appeal fee of $100 for appeals of system development charges is consistent with applicable policies and directives of the City Council, including those developed during the Eugene Decisions process, the amount charged for comparable appeals, and is necessary in order to recover the costs incurred by the City in processing such appeals. On the basis of these findings, I order that: An appeal fee of $100 is hereby established for appeals of system development charges, to become effective April 4, 1994.
