ADOPTING PARKING SPACE RENTAL PERMIT
ADMINISTRATIVE RULE R-S.3S0
Pursuant to the authority contained in Sections 2.019 and 5.350 of the Eugene Code,
1971, I hereby adopt Parking Space Rental Permit Administrative Rule R-5.350 that
provides as follows:

Puroose.
The purpose and intent of this rule is to furnish greater detail regarding the issuance,
use and revocation of the parking space rental permits authorized under Section 5.350 of
the Eugene Code, 1971. Parking space rental permits may be issued for the vehicular use
of a portion of public right of way as a designated parking space, or other portion of the
right of way as authorized for commercial operations involving construction, maintenance,
or moving activities. A parking space rental permit may be issued on an individual basis for
a non-commercial use provided the applicant can demonstrate that except for the non-
commercial nature of the proposed activity the application would otherwise meet the criteria
for issuance of a permit, and failure to issue the permit would seriously prejudice or
inconvenience the applicant.
R-S.3S0-B. Use Areas.
Parking space rental permits may be issued for parking spaces in the following areas:
1. Metered parking areas;
2. On-street time limit areas;
3. City controlled parking lots;
4. Downtown mall;
S. Other areas of the right-of-way where parking is restricted,
except that a permittee shall not, in any of the authorized areas, park a vehicle in a parking
space where the period of time a vehicle may be parked is limited to less than one hour, or

in an unsafe manner.

Placement and Use of Permits.
1. Parking space rental permits may not be used on Sundays, holidays, or
between the hours of 6:00 p.m. of one day and 7:00 a.m. of the following day on Monday
through Saturday.
2. Upon entering the parking space and/or location approved in the application,
the permit holder shall place the permit face up on the driverside dashboard of the vehicle
with the recorded validation readable from outside the vehicle. The permit holder shall not
attempt to use any space which is occupied by another vehicle, and must wait until such
space is vacant. If after securing the space the permit holder finds it necessary to remove
the vehicle therefrom for a period of time, proper barricades may be erected to reserve the
space. The permit or the written approval on the application for the permit must be
available in the immediate vicinity for verification by appropriate city personnel when
barricades are used. Upon vacating the space at the conclusion of normal working hours,
and in any event, prior to 6:00 p.m., the permit holder shall remove any barricades that have
been placed in the space. Permits issued hereunder shall be used only when the parking of
a vehicle is essential to the performance of the work being done. Permits may not be used
for parking vehicles that are primarily used for transporting workers to and from the work
site. The vehicle for which the permit is issued must be parked in the designated area and
be directly involved in and necessary for the work being performed.
R-S.3S0-D Exceptions.
The traffic engineer, or designee, may grant exceptions to these rules upon a showing
of special circumstances by the applicant. No exception hereunder shall be valid unless
issued in writing by the traffic engineer or designee.

Revocation of Permit.
Failure of a permittee to comply with the provisions of the Eugene Code, 1971
regulating parking space rental permits, these rules, or any conditions imposed on a permit
shall be cause for revocation of the permit and retention by the City of all fees previously
paid therefor.

Appeal.
A decision of the City Manager, Traffic Engineer, or the designee of either,
concerning the issuance, denial or revocation of a parking space rental permit may be
appealed by the applicant or permittee in the manner provided in Section 5.045 of the

Eugene Code, 1971.
This Rule is adopted after giving public notice by publication thereof in the Register
Guard, a newspaper of general circulation within the City for at least five days, to-wit, on
August 4, 5, 6, 7 and 8, 1994 that on July 28, 1994 I adopted an administrative order
proposing the adoption of Parking Space Rental Permit Administrative Rule R-5.350, by
making copies thereof available at the office of the City Manager, 777 Pearl Street, Eugene,
Oregon, during normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday,
exclusive of holidays), and to any person who has requested such notice. The notice advised
that interested persons could submit written comments thereon for a period of not less than
15 days from the date of publication. No valid comments or objections were received within
the time and in the manner prescribed in the notice, and Parking Space Rental Permit
Administrative Rule R-5.350 as contained herein is hereby adopted.
