HomeMy WebLinkAboutAdmin Order 58-96-07 S8-q~-D7 Administrative Order of the Traffic Engineer of the City of Eugene, Oregon Prohibiting Through Truck Movements and Establishing Vehicle Use Restrictions on Stewart Road The Traffic Engineer of the City of Eugene finds that: A. Section 5.040 of the Eugene Code provides that the City Manager or the manager's designee shall exercise specific traffic duties by administrative action, including: ~ Implementing ordinances, resolutions, and motions of the Council and his or her own orders by installing traffic control devices; ~ Designating truck routes or streets where trucks are prohibited; and ~ Restricting the use of certain streets by any class or kind of vehicle to protect the streets from damage. B. On April 3, 1996, the City received a citizen request to prohibit through truck traffic on Stewart Road. The request stated that trucks were contributing to the deterioration of the unimproved section of the road, and were a nuisance and hazard to residents; C. Transportation Division files contain numerous complaints regarding truck traffic on Stewart Road; D. Stewart Road consists of two sections; an easterly section is .27 miles long, has primarily residential frontage with an 18 foot wide unimproved asphalt mat surface. The westerly section is .40 miles long, has primarily industrial frontage and a 44 foot wide asphaltic-concrete surface. E. In response to earlier concerns of residents, the speed zone on the easterly section was lowered from Speed 40 to statutory Speed 25 on January 20, 1994. The existing Speed 40 zone was retained on the westerly portion of the street. F. Traffic volumes are similar on each section; Average Daily Traffic in September 1995 was 1,359 west of Bailey Hill Road and 1,564 east of Bertelsen Road. G. There was one accident on the improved section of Stewart Road in 1994 and none on the unimproved section. H. On a scale of 0 to 100, the easterly section has a condition rating of 4. This means that the road has completely failed and has exceeded its useful life. I. The asphalt mat section has a large number of potholes which require continual maintenance. The condition of the pavement makes it difficult to perform long lasting repairs. The Maintenance Division filled in potholes sixteen times in the two year period January 1, 1994 through December 31,1995. J. Despite the numerous repairs, the easterly section still has a many potholes. K. Improving the easterly section would require assessing adjacent property owners for the cost of the project. Property owners are opposed to street improvements. L. Prohibiting trucks in excess of 16,000 pounds GVW on the easterly section of Stewart Road will prolong the useful life of the roadway and still allow access to adjacent properties. NOW, THEREFORE, Based on the above findings, and pursuant to the authority contained in Eugene Code 5.040, the Traffic Engineer of the City of Eugene orders that: Through truck movements shall be prohibited on Stewart Road; and All vehicles exceeding 16,000 Pounds gross vehicle weight shall be prohibited from driving on Stewart Road between Bailey Hill Road and a point 0.27 miles west of Bailey Hill Road. Dated thiJ] /<1 Day of May, 1996 Administrative Order Number 58-96-07 Administrative Order of the Traffic Engineer of the City of Eugene, Oregon Prohibiting Through Truck Movements and Establishing Vehicle Use Restrictions on Stewart Road Criteria for Administrative Action The administrative action of the Traffic Engineer of the City of Eugene, Oregon, prohibiting through truck movements and establishing vehicle use restrictions on Stewart Road is based on the following criteria: (a) Traffic engineering principles and traffic investigations: . Roadway and intersection capacity: Not applicable. . Safety: Not applicable. . Traffic signs, markings and signals: Signs, markings and signals will be added, removed, or modified as needed to comply with the Manual on Uniform Traffic Control Devices. . Intersection Control: No changes will be made to intersection controls. . Roadway lighting: No street lighting changes will be made. . Access control: Truck access will be impaired. Trucks will not be allowed to use Stewart Road as a through street, and trucks over 16,000 pounds GVW will be prohibited on the easterly section of Stewart Road. . Speed zoning: No changes will be made to the existing speed zones. (b) Standards, limitations, and rules promulgated by the Oregon Transportation Commission or the Oregon Public Utility Commission or their successors. . No applicable standards, limitation, or rules apply. @ Other recognized traffic control standards. . Signing and markings will comply with the Manual on Uniform Traffic Control Devices. (d) The city's adopted transportation-related plans and policies. . No city adopted transportation.,.related plans relate to this street. (e) Existing state and local laws regulating use of public ways. . The Eugene Code grants the City Traffic Engineer the authority to regulate the use of streets by designating streets where trucks are prohibited and restrict the use of certain streets by any class or kind of vehicle to protect the streets from damage. (f) The efficient use of the public way by the public. . The through truck prohibition and weight restriction will inconvenience some truck movements. Through trucks will be required to go through the 11 th Avenue - Bailey Hill Road intersection, which may increase their travel time. Local trucks over 16,000 pounds GVW will be inconvenienced by being required to enter and exit Stewart Road from Bertelsen Road. (g) The use of abutting property. . Use of abutting property will be adversely affected to the extent that access is restricted. See section (f), above. (h) The intensity of use of the street by vehicles and pedestrians. . Traffic volumes will decrease, as truck traffic will be reduced; pedestrian traffic will remain low. (I) The physical condition and characteristics of the street and abutting property. . The easterly portion of Stewart Road 18 feet wide, with an asphalt mat surface that is in poor condition. The south side of the street consists of single family residences, while the north side is mostly undeveloped. . The westerly portion is an improved 44 foot wide street, with a number of small industries on the south frontage. The north side is a dedicated wetlands. (j) Emergencies. . Emergency vehicle services won't be affected by this project. (k) The public health, safety, and welfare. . The public health, safety and welfare won't be affected by this project.. (1) Special events of community interest including parades and public gatherings. . Not applicable. (m) Construction within or adjacent to the street. . Construction within or adjacent to the street will be more difficult, as large trucks would not be allowed on the easterly portion of the street. (n) Establishing conditions upon the use of parking. . Not applicable. Administrative Order #58-96-08 Administrative Order of the Public Works Executive Manager Contract/Change Order Delegation of Authority Under Administrative Order of the City Manager, the Public Works Executive Manager has the delegated authority to execute contracts on behalf of the City Manager of Eugene in the amount of $50,000 or less. This authority includes the execution of contract change orders which are within budget contingency for that contract or project, and are within change order guidelines of Public Contract Administrative Rules. Based on the above, the Public Works Executive Manager orders that: 1. Public Works Division Managers shall be responsible to the Public Works Executive Manager for: the initiation, content, award, obtaining of signatures, budgetary encumbrance, consistency with local budget law, filing with the City Recorder, administration, and compliance with applicable federal, state and local statutes and policies for contracts which carry out the programs of their divisions. 2. All Public Works contracts shall be submitted to the Public Works Executive Manager for execution. Contracts for amounts over $50,000 shall be initialed by the Public Works Executive Manager and signed by the City Manager. 3. Any contract submitted to the Public Works Executive Manager for execution shall have the initials of the Division Manager who recommends execution of the contract. 4. The City Engineer, Airport Manager, and Facilities Division Manager shall have the authority to execute change orders for construction contracts which are within budget contingency for that contract or project, and are within change order guidelines of the Public Contract Administrative Rules. Any change order shall be consistent with applicable provisions of the original contract.
