of the
City Manager Pro Tern of the City of Eugene
AMENDING MWMC PROVISIONS OF
SYSTEMS DEVELOPMENT CHARGE METHODOLOGY
The City Manager Pro Tern of the City of Eugene finds as follows:
A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager of the City
of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of
municipal property, and licenses and permits, and specifically systems development charges. Section 7.710
of the Eugene Code, 1971 further authorizes the City Manager to adopt and/or amend by administrative order,
the methodologies used for establishing the systems development charges, and provides this may be effected
concurrent with the establishment or revision of a systems development charge.
B. In accordance with the procedures set forth therein, on May 27, 1998, I notified the Mayor
and City Councilors that I intended to amend the Systems Development Charge Methodology relating to the
Metropolitan Wastewater Management Commission (MWMC) by increasing fees for the Regional Wastewater
Systems Development charge, eliminating the shopping center category from the rate table as this type of
establishment is more accurately described by other categories in the table, and updating the MWMC credit
table. MWMC has completed an annual update of the value of its assets, the value of proposed future
improvements, and the value of prior property tax payment contributions for existing vacant land. These
changes are the basis for the proposed increase in the MWMC SDC rates.
C. The Notice was also posted in four public places within the City and published in the Register
Guard, a newspaper of general circulation within the City on May 27, 1998 and June 8, 1998. The Notice
provided that written comments could be submitted thereon for a period of 30 days from the date of posting
and publication. No comments were received within the time or in the manner required by the Notice.
D. I fmd that the revisions to the Systems Development Charge Methodology and the fees as set
forth in Exhibit A (Table I-page 3, Table 5- page D-9, Attachment 3-page D-l 0, Attachment 4-page D-ll,
Calculations-page G-4, and Section 2.3-page G-6) hereto are consistent with adopted policies and ordinances
of the City, in conformity with applicable state law, and should be implemented effective July 1, 1998. Those
portions of the Systems Development Charge Methodologies adopted by Administrative Order No. 58-97-02-
F-2 and Administrative Order No. 58-97-07-F, in conflict herewith should be amended as of that effective
date.
On the basis of these findings, I order that:
1. The MWMC provisions of the Systems Development Charge Methodology, the MWMC
Credit Table, and the rate table are hereby amended as set forth in Exhibit A, including the attachments
thereto, which are attached hereto and incorporated herein by reference effective July 1, 1998.
2. Those portions of the Systems Development Charge Methodologies adopted by Administrative
Order No. 58-97-02-F-2 and Administrative Order No. 58-97-07-F, in conflict herewith are hereby amended
as of July 1, 1998.

2~3 Change of Use
When a change of use of an existing development results in an increased impact
on the regional wastewater facilities (as demonstrated by calculating the SDC for
both uses), the SDC wiIJ be charged on the increased impact. This is determined
by calculating what the development's charge would be for the current use, and for
the proposed use. If the proposed use would result in a higher charge, the
difference is collected.
2.4 MWMC SOC Credit
A credit for property taxes on real property paid to retire bonded debt incurred for
the construction of regional wastewater facilities shall be deducted from the MWMC
SOC. The credit shall accrue from the year of annexation to the City, and be
based upon the assessed value of the real property at the time of application for
connection to the system. The current credit is shown in Attachment 4.
2.5 MWMC Administrative Charge.
A further adjustment to the regional wastewater SOC is the addition of
administrativ€ costs. MWMC will incur staff costs for the updating and processing
of the charge. These costs are applied on a per connection basis. The Regional
Wastewater Administrative Charge per pennit is applied to the total SDC fees after
all other charges and credits have been applied.
