AN ORDINANCE AUTHORISING THE INSTITUTION
of PROCEEDINGS IN EMINENT DOMAIN FOR THE
ACQUISITION BY CONDEMNATION OF PROFERTY
INTERESTS ON FAIRWAY DRIVE FROM HORN LANE
To WEST HILLIARD AND ON PARK TERRACE FROM
SUNNYSIDE DRIVE TO PARR AVENUE; AMENDING
ORDINANCE NO. 19249; AND DECLARING AN
EMERGENCY.
The City Council of the City of Eugene finds that:
By Ordinance No. 19249 passed by the City Council and approved
by the Mayor on May 29, 1984 the Council declared the necessit

of the acquisition of certain real propert interests mare arti
y p cu
larly described in Exhibit A thereto in order to construct a
sanitary sewer pump station, sanitary sewers, force lines and or
facilities related thereto in the River Road and Santa Clara
areas, and authorized the institution of proceedings in eminent
domain for the condemnation of those real property interests.
Since adoption of that Ordinance it has been determined
that the portions of necessary right of way on Fairwa Drive
Y
from Horn Lane to West Hilliard and an Park Terrace from Sunn
Y
side Drive to Park Avenue are not dedicated ublic roads. Th e
p
acquisition of permanent easements and temporary construction
permits are therefore necessary in order to construct the im-
provements authorized by Ordinance No. 19249. Now, therefore,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Based upon the above findings, and the findin s

contained in Ordinance No. 19249, which are adopted and incor or-~

ated herein, the City Council does hereby find, declare and
