HomeMy WebLinkAboutOrdinance No. 19278c:ns~nurru.~7' ~ $~36`16D ~IRL~ ~ ~.~~5~ ORDINANCE NO. ~ ea~, 7 An Ordinance vacating the following described alley, to-wit: The alley lying between the north line of lots 7, 8 and 9 and the south line of lots 1~, 11 and 12, Block 29; Driverton Addition to Eugene as platted and recorded in Volume 4, Page 22, Lane County Oregon Plat Records. RESERVING herein a public utility easement upon the easterly 25 feet of the above described property for location and maintenance of the existing anchor which is part of the overhead electrical system located in the north--south alley to the east. On the 11th day of July, 1984, the City Council of the City of Eugene passed Ordinance No. 19263 setting a hearing to be held on the 15th day of August, 19$4, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place pro tests and remonstrances could be heard as to the proposed vacation of the above described alley. Notice was duly and regularly given of the hearing and at said time and place the City Council continued the hearing to September 12, 1984 at the Council Chambers, City Hall, Eugene, Oregon, at noon, Pacific Daylight Time, and at said time and place the Council heard all objections. All persons owning property abutting the alley to be vacated have consented to the vacation and applied for the same. THE CITY OF EDGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and posted as by law required and no valid objections have been 1- Ordinance /9~~s made at the hearing or f i led . The consent of the owners of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the alley. Section 2. The hearing was held on the 12th day of September , 1984 at noon, Pacific Daylight Time, at the Council Chambers, City Hall, Eugene, Lane County, Oregon, and all matters necessar Y to be done in the premises have been duly and regularly completed. Section 3. The hereinabove described alley is hereby vacated, and the alley so vacated shall revert pursuant to the statutes of the State of Oregon. Section 4. The C i ty Recorder is hereby directed to f i le a certified copy of this Ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certified copy of this Ordinance shall be filed with the Lane County Assessor and another certified copy shall be file d with the Lane County Surveyor.
