The City Council of the City of Eugene finds that: A. Sorrel Way provides a pedestrian and bicyclist connection between the Oakway Mall-Oakmont shopping area, residential areas, and the Washington Elementary School. Portions of the area have sidewalks on one side of the street, while in other portions, no sidewalks exist. B. The City Engineer has determined that construction of sidewalks adjacent to properties on Sorrel Way from Roan Drive to Coburg Road is consistent with the Eugene Sidewalk Program Document adopted by the Council on July l4, 198, and is necessary in order to complete gaps in the sidewalks on both sides of Sorrel Way. C. The portion of the project between Coburg Road and Rustic Place has been identified as a high priority area for sidewalk placement by the 198 Eugene Sidewalk Program Document, and the Harlow Neighbors neighborhood association has requested the installation of sidewalks on Sorrel Way between Rustic Place and Roan Street. D. A public hearing concerning the proposed sidewalk construction was held before Hearings Officer Jack A. Billings on April 12, 1984 at the request of property owners. At that hear- ing, public comment and a City staff presentation was received, and the Hearings Official reviewed the Eugene Sidewalk Program Document and conducted an on-site investigation. Based thereon, the Hearings Official entered findings that there is a need for construction of sidewalks on Sorrel Way from Roan Drive to Coburg Road , and that property owners be notified of their right to construct the sidewalks at their own expense by July 15, 1984, and if not so constructed, that the City Council should initiate construction through a local improvement project as provided in sections 7.16 to ?.~7~ of the Eugene Code, 1971. E. The report and findings of the Hearings Official have been reviewed by the Council and should be approved. NOWT THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Based upon the above findings, which are incorporated herein, the City Council hereby approves and adopts as its own, 1 ~- Ord ~. Hance i9zsy the findings of the Hearings Official of April 12, 1984, and finds that construction of sidewalks on both sides of Sorrel Way from Roan Drive to Coburg Road is consistent with the Eugene Sidewalk Program Document and necessary to complete gaps in sidewalks in that area. Section ~. The City Engineer is directed to provide the affected property owners with information as to the location of the sidewalks, the materials required to be used in their construc- tion, and the date by which the construction is to be completed, ~n such notice, the affected proeerty owners shall be advised of their right to construct the sidewalks at their own expense at any time prior to May 1, 1985, and notified that if they fail to do so, the City Council will initiate construction through a local improvement project under the provisions of Section 7.16 to ?.27~ of the Eugene Code, 1971. Section 3. That the matters contained herein concern the public welfare and safety and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor. A public hearing regarding a proposed sidewalk construc- tion project along Sorrel Way was conducted in the City Council Chambers a~~~ April 12,1984, at 7: 3~ P.M. Hearings Official Jack A. Billings presided. 2. A staff presentation was made by Dave Reinhard, assisted by Donna Hickey. Mr. Reinhard stated that the purpose of the project on Sorrel Way was to complete gaps in the sidewalks on both sides of Sorrel Way between Coburg Road and Roan Street. That portion of the project between Coburg Road and Rustic Place has been identified in the 1984 Eugene Sidewalk Program document as a high priority area for sidewalk placement. The Harlow Neighbors had requested that sidewalks also be installed on Sorrel Way between Rustic Place and Roan Street. Mr. Reinhard noted that Sorrel Way provides a pedestrian and bicyclist connection between the Oakway Null--Oakmont shopping area on the west and residential areas and Washington Elementary School on the east and north. This connection is along Sorrel, north on Roan and across an easement at the end of Dapple Way to Sunshine Acres Drive. He noted that in the area between Oakmont and Rustic Place there are no sidewalks on either side of Sorrel Way, with the exception of one lot. Between Dartmore and Harnbletonian there are sidewalks on only~the south side of the --1- iq-~~y street. Mr. Reinhard described the process which would be followed by city staff if the project is approved by the Hearings Gfficial, 3. Public testimony was as follows: A. HARQLD BERG Mr. Berg spoke as a representative of property owners who appose the project. He said that a survey was made within the Harlow Neighbors area which determined that the greater number of streets have no sidewalks . He said that if safety i s the ley factor, a greater study of the schools in the area, N~onroe and Washington, is needed. He said he had not heard complaints about safety, He read a letter from another property owner, Robert l~ccaffrey who also stated the fact that less than ~.. ~..,~ half the streets in the area have sidewalks. B, J0 ANNE ARNOLD She stated that there is a safety problem on Sorrel way, but it is more than a lack of sidewalks. She stated a concern about the narrow streets which may require widening and new curbs in the future, She later asked a qustivn whether it was possible to consider restricting parking to one side of the street and installing sidewalks on the other. Mr, Reinhard responded that it would be the city policy to require sidewalks on both sides of the street. c, BETH scHR~~~NGOST She is the mother of two small children who often walk _~_ ~z8y in the area. She believes that sidewalks are necessary and that she has seen and experienced close calls because of the lack of them. She also believes that a part of Country Lane should have a sidewalk on at least one side of the street, D . Boy Mc NUTT ~~ Nor, McNutt stated that he is not apposed to the sidewalks in general, but would like to put in his sidewalk when his property is developed, He awns an undeveloped piece of pro- perty along Oakmont Way. E, MARTHA SAUNTRY ~f ormer chair, Harlow Neighbors She believes that the area is dangerous because of a high number of walkers and bike traffic ~ together with automobile traffic. She also noted that a number of those who live in the area are older and that the sidewalks ought to be put in to make way for the next generation, F. JOHN CALLICRATE 4current chair, Harlow Neighbors Mr, Callicrate stated that the Harlow Neighbors endorse the current project. He stated that during meetings members have commented that there is a need for sidewalks on both sides df Sorrel. G. CURTIS DIXON He believes there is only slight foot traffic on Sorrel Way and cannot see the need for this project, He also noted that sidewalks should be required throughout the area, if they are required on S or r e 1 Way 4, In response to the comments made by members of the - 3 ~- lq~ sy public, Nor. Reinhard stated that the city is focusing on those streets which are used as connectors from one area to another, He agreed that it would be preferable to have sidewalks on all streets, but that process must begin somewhere. He also stated that the city would be willing to work with property owners to arrange placement of the sidewalks to reduce the impact to existing shrubbery as much as possible. He also stated that property owners can undertake to build the sidewalks themselves, if the project is approved by the Hearings official and ultimately the City Council. He stated that Bancrofting would be available if the city did install the sidewalks. In response to a question, he stated that the current rate of interest for- Bancrofting is 14~. The Hearings Official heard public comment and staff presen- tation, reviewed the Eugene Sidewalk Program Document, as adopted by the City Council on July 14, 1984, and conducted an on-site investigation, The HEARINGS OFFICIAL FINDS AS FOLLOWS: 1. In accordance with Section 7.155 of the Eugene Code, 1971, there is a need for sidewalks on Sorrel Way from Roan Drive to Coburg Road; 2, In accordance with Section 7.156 of the Eugene Code, 1971, property owners shall be notified of their right to construct the sidewalks at their own expense by July 15 , 198 4 ; and if not so constructed , the City Counci 1 shall initiate construction through a local improvement project, as provided in Sections 7.16o-7.Z7~ of the Eugene Code, 1971.
