HomeMy WebLinkAboutAdmin Order 58-01-18-F ADMINISTRATIVE ORDER NO. 58-01-18-F of the City Manager of the City of Eugene AMENDMENT OF FEES FOR RIGHT-OF-WAY CUT PERMITS AND REPEAL OF ADMINISTRATIVE ORDER NO. 58-97-09-F.- The City Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits. In accordance with the procedures set forth therein, and the further authority of Section 7.300 of the Eugene Code, 1971, Administrative Order No. 58-97-09-F was adopted on June 26, 1997, establishing right-of-way use permit fees. A portion of the fee schedule adopted by Administrative Order No. 58-97-09-F was subsequently amended and is incorporated in the fee schedule adopted by Administrative Order No. 53-01-07-F. This order amends the fees not included in the schedule attached to Administrative Order No. 53-01-07-F. B. In accordance with the procedures set forth in paragraph A above, on December 23, 2001, I notified the Mayor and City Council that I intended to rename Right-of- Way Cut Permit Fees to Utility Right-of-Way Use Permit Fees and amend those fees, to be phased in over a three-year period, based on the calculations of City staff, in order to recover the full costs associated with permitting and inspection. C. The Notice was also published in the Register-Guard, a newspaper of general circulation within the City, on December 23, 24, 25, 26 and 27, 2001, and made available for inspection by interested persons at the offices of the City Manager, 777 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). The Notice provided that written comments would be received thereon for a period of30 days from the date of publication. Notice was also posted at two locations at City Hall on January 14, 2002, and provided that written comments would be received for a period of 30 days from December 23,2001. D. No comments were received within the time or in the manner required by the Notice. However, during the comment period, staff discovered a typographical error in the fee schedule under Individual Permit Costs, and recommended that "Projects from 500 to 100 ft." should read "Projects from 500 to 999 ft." I concur with the recommendation and the correction has been incorporated into the fee schedule. E. I find that the fees set forth in Exhibit A hereto are consistent with applicable policies Administrative Order - 1 C:\WINDOWS\TEMP\Ol UtilityROW2ao.wpd and directives of the City Council, comparable to the fees established in other jurisdictions for providing such services, and are necessary in order to comply with the City Council's directive and the requirements of Section 7.300 of the Eugene Code, 1971, that all of the City's costs related to processing the applications for the permits and inspecting the work during and after completion of the work be fully recovered. On the basis of these findings, I order that: 1. The fees set forth in Exhibit A hereto are hereby established as the fees to be charged for the services set forth therein as of the effective date of this order. 2. The unamended fees are ratified and Administrative Order No. 58-97-09-F and the fees established therein are repealed as of the effective date of this order. Projects greater than 2000 ft. in length will be charged the appropriate permit multiples equal to the length of activity. 2. Failure to obtain a Utility Right-of-Way Use Permit prior to commencing a work activity requiring the said permit will result in a fee assessment equal to twice the original permit fee without the benefit of any joint trench fee reductio"n. 3. Costs designated are for each facility within the joint trench. 4. The option of applying for an annual blanket permit is only available to Providers Franchised or Licensed by the City. Providers have the option of obtaining individual right-of-way cut permits for each excavation activity performed within the right-of-way or obtaining an annual blanket permit which covers many activities associated with maintenance and minor installations within the right-of-way. The regulations pertaining to the annual blanket permit program are contained within Administrative Rule R-7.302-A-2. 6. Individual Permit Costs for collector streets and alleys are charged the same as local streets. 7. Individual Permit Costs for Public Utility Easements (PUE) abutting street right-of-way shall be charged at the same rate as if the placement had been in that right-of-way. PUEs not abutting street right-of-way shall be charged at the rate for local streets.
