ADMINISTRATIVE ORDER NO. 58-02-18-F
of the
City Manager pro tern of the City of Eugene
AMENDMENT OF REGIONAL (MWMC) WASTEWATER
SYSTEMS DEVELOPMENT CHARGE (SDC) CREDIT
RATES.
The City Manager pro tern of the City of Eugene finds as follows:
A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager of the City of
Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of
municipal property, and licenses and permits. Eugene Code 7.71 O( 5) authorizes the City Manager
to adopt by administrative order changes to SDC rate factors and cost indices.
B. The SDC Methodology which had been adopted by Administrative Order No.5 8-0 1-
11-F, was repealed by Administrative Order No. 58-02-12-F and the SDC Methodologies were
adopted by Council Resolution No. 4717.
C. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the
Eugene Code, 1971, on June 3, 2002, I issued Administrative Order No. 58-02-18 and notified the
Mayor and City Councilors that, pursuant to a request by the Metropolitan Wastewater Management
Commission (MWMC), I intended to adjust Table 9 (the Regional (MWMC) SDC Credit Rates),
which is included in the SDC Methodologies that were adopted by Resolution No.4 71 7, by updating
the credit rates to reflect passage of a year as set forth in the Notice of Intended Fees attached as
Exhibit A to the Administrative Order. This adjustment is based on a periodic application of
previously adopted factors related to rates.
D. Notice was also posted at two locations at City Hall on June 6, 2002, and made
available for inspection by interested persons at the office of the City Engineer, Public Works
Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to
5:00 p.m., Monday through Friday, exclusive of holidays). Notice provided that written comments
would be received for a period of 15 days from the date of posting. No comments were received
within the time or in the manner set forth in the Notice.
E. I find that Regional (MWMC) Wastewater SDC Credit Rates should be amended as
proposed and that the rates set forth in Exhibit A attached hereto are consistent with adopted policies
of the City, in conformity with applicable state law, authorized by EC 7.710(5), and should be
implemented effective July 1, 2002.

On the basis of these findings, I order that:
1. Table 9 set forth in Exhibit A hereto are the Regional (MWMC) Wastewater SDC
Credit Rates to be implemented effective 12:01 a.m. on July 1,2002.
2. The SDC Methodologies adopted by Resolution 4717 is amended by replacing the
existing Table 9 with the Table 9 set forth in Exhibit A attached hereto, and the remainder of the
SDC Methodologies remain in full force and effect.
3. The City Recorder append this Administrative Order to the SDC Methodologies
adopted by Resolution 4717.
