ADMINISTRATIVE ORDER
of the
city Manager
city of Eugene, Oregon
The City Manager of the City of Eugene finds that:
Under the provisions of Chapter IV, Section 16 of the Eugene
Charter of 1976, as supplemented by Resolution No. 4106 adopted
by the Council on January 18, 1989, the City Manager, as business
agent for the City, is authorized to sign and execute on behalf
of the City, contracts and other documents as may be required
from time to time.
Under the City's adopted annexation policy, agreements
governing annexation to the City are entered into from time to
time between the City and affected property owners. Those
agreements are currently executed by the City Manager on behalf
of the City.
section 2.212 of the Eugene Code, 1971 authorizes the City
Manager, or the Manager's designee to receive requests for
extraterritorial water service extensions, sewer service
extensions, or provision of water or sewer service to special
service districts. The city Manager or designee is further
authorized by that section to submit the city's favorable
recommendation on such requests to the Lane County Local
Government Boundary Commission based on findings as specified
therein.
Requests for annexation, extraterritorial water service
extensions, sewer service extensions, or provision of water or
sewer service to special service districts are processed
initially by the City's Planning, Development & Building
Department, and it would therefore be more efficient and
expeditious to delegate authority to Abe Farkas, Director of that
Department, to execute on behalf of the City agreements governing
annexation and to carry out the City Manager's responsibilities
under section 2.212 of the Eugene Code, 1971 with respect to
requests for extraterritorial water service extensions, sewer
service extensions, or provision of water or sewer service to
special service districts.
Abe Farkas, Director of the Planning, Development & Building
Department should also be specifically authorized to delegate all
or any of these duties or responsibilities if he determines it
would be more efficient and in the public interest to do so.
NOW, THEREFORE ,
THE CITY MANAGER OF THE CITY OF EUGENE ORDERS AND DIRECTS
Administrative Order
THAT:
Based on the above findings, which are hereby adopted, Abe
Farkas, Director of the Planning, Development & Building
Department of the City of Eugene is hereby authorized to:
1. Execute
to be executed
notices of such
other documents
executed;
on behalf of the city, all agreements required
in connection with annexations, including any
agreements, modifications of the agreements, or
required by the agreements to be subsequently
2. Receive requests for extraterritorial water service
extensions, sewer service extensions, or provision of water or
sewer service to special service districts, and to submit the
city's favorable recommendation thereon to the Lane County Local
Government Boundary Commission upon finding the same to be in
compliance with the provisions of section 2.212 of the Eugene
Code, 1971; and
3. Delegate any of the duties or responsiblities referred
to herein to such person or persons he considers qualified to
perform the delegated duties upon finding it would be more
efficient and in the public interest to do so.
