HomeMy WebLinkAboutAdmin Order 53-91-20 ~ltX FILE NO. .:)~- q \ - 30:.- ADMINISTRATIVE ORDER of the City Manager of the City of Eugene CONCERNING FEES FOR APPEALS TO THE HEARINGS OFFICIAL FROM DECISIONS SUBJECf TO REVIEW UNDER SECTION 3.060 OF THE EUGENE CODE, 1971 The City Manager of the City of Eugene finds as follows: 1. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits. 2. In accordance with the procedures set forth therein, on April 4, 1991 I notified the Mayor and City Council that I intended to establish fees for appeals to the Hearings Official from decisions subject to review under the provisions of Section 3.060 of the Eugene Code, 1971, which include business license appeals (including hazardous materials licenses/permits, and fire safety permits), public passenger vehicle permits, and individual certification denials, revocations, and suspensions. The notice was also posted at two locations at City Hall on April 5, 1991, and made available for inspection by interested persons at the offices of the City's Planning & Development Department, Building & Permit Services Division, 244 East Broadway, Eugene, Oregon 97401, and provided that written comments would be received thereon for a period of 15 days from the date the notice was posted. No written comments were received within the time or in the manner required by the notice. 3. I find that the proposed fees as set forth in the Notice are consistent with applicable policies and directives of the City Council, the amount charged for comparable Administrative Order - 1 appeals, and are necessary to recover the costs incurred by the City in processing such appeals. On the basis of these findings, I order that: 1. The following fees are hereby established for appeals to the Hearings Official from decisions subject to review under the procedures of Section 3.060 of the Eugene Code, 1971: Business License Appeals (including hazardous materials licenses/permits, and fire safety permits) ............. $100.00 Public Passenger Vehicle Permits $ 50.00 Individual Certification Denials, Revocations, Suspensions ................................. $ 50.00 2. The fees established herein shall be applicable to all such appeals filed after the effective date of this order as indicated below.
