ADMINISTRATIVE ORDER

FIRE SAFElY LICENSES ADMINISTRATIVE RULE R-3.175
Pursuant to the authority contained in Section 2.019 of the Eugene Code, 1971, I
hereby adopt the following Fire Safety Licenses Administrative Rule R-3.175:
FIRE SAFElY LICENSES - ADMINISTRATIVE RULE R-3.175
R-3.175-A. Application Information.
1. An applicant shall complete a fire safety license application form provided
by the City.
2. The application form may generally require the following information:
2.1 Name of the firm or organization;
2.2 Location of the facility;
2.3 Manager's and owner's name;
2.4 Mailing address and telephone number;
2.5 Nature of the facility's operation;
2.6 Type and amount of flammable liquids, explosive materials,
hazardous and/or toxic materials used, stored, dispensed, handled,
manufactured or disposed of at the facility.
3. A separate application form may be required for each facility.
4. If the applicant is a firm of foreign origin, additional information including
the place and date of incorporation, home office, right to do business within the state, firm
or organization officers and/or its duly authorized local agent may be required.
R-3.175-B. Fees Required of Applicant.
All application, processing, checklist review, special event, or other fees shall be
established by the City Manager pursuant to Section 2.020 of the Eugene Code, 1971.

The processing fee and the checklist review fee must be paid before the City will begin its
review of the application.
R-3.175-C. Displav of License.
A fire safety license shall be posted in a conspicuous location near the primary
entrance of the facility so as to be immediately visible to any inspector.
R-3.175-D. Special Event License.
A special event fire safety license may be issued upon completion of an application
form therefor, which shall be provided by the City, and payment of required fees. The
special event license shall be valid only for the time, place and duration of the special
event as specified thereon.
R-3.175-E. Hold Harmless A2reement.
The applicant shall furnish to the City a signed statement that the licensee shall
hold harmless the City, its officers, agents, and employees and shall indemnify the City, its
officers, agents and employees for any claims of injury to property or persons that may
arise as a result of any activity carried on by the licensee. The agreement shall be
approved by the City Attorney before it will be accepted by the City.
This Rule is adopted after giving public notice by publication thereof on May 14,
15, 16, 17, and 18, 1991 in the Register Guard, a newspaper of general circulation within
the City that on May 10, 1991 I adopted a Proposed Amendment of Fire Safety Licenses
Administrative Rule R-3.175 and by making copies thereof available to current Fire Safety
licensees, persons who had requested notice, and other interested persons at the office of
the City's Planning & Development Department, Permit Services Division. The Notice
advised that an opportunity for written comment thereon would be provided for a period
of 15 days from the first date of publication. No comments have been received within the
time or in the manner required in the notice, and this Rule is therefor adopted as
proposed.

AMENDMENT OF FIRE SAFElY LICENSES
ADMINISTRATIVE RULE R-3.17S
NOTICE IS HEREBY GIVEN that pursuant to the authority contained in
Section 2.019 of the Eugene Code, 1971, Micheal D. Gleason, City Manager of the
City of Eugene, intends to adopt as a permanent rule the Proposed Amended Fire
Safety Licenses Administrative Rule R-3.175 adopted by the City Manager on May
10, 1991, which:
Sets forth required application information; how required fees
are established; requirements for display of license; provisions for
special event licenses; and hold harmless agreement requirements.
The Proposed amendment of Fire Safety Licenses Administrative Rule R-
3.175, is necessary for the preservation of the safety and welfare of the public, and
may be reviewed at the office of the Planning & Development Department, Permit
Services Division, 244 East Broadway, Eugene, Oregon 97401 during normal business
hours.
AIl persons wishing to comment thereon or object thereto must submit their
comments or objections to the City's Planning & Development Department, Building
& Permits Services Division, 244 East Broadway, Eugene, Oregon 97401, in writing,
within fifteen (15) days of the date of the first publication hereof, as indicated below.
The City Manager will thereafter adopt the Proposed Fire Safety Licenses
Administrative Rule R-3.175, as a Permanent Rule.
