ADMINISTRATIVE ORDER TO SET CITATION BAIL AMOUNT
Attached is an Administrative Order to set a bail amount for the violation of
leaving a paid parking facility. We do not have a method to cite the offend-
ers at this time. There is a code item, but there is no citation amount set
or a method to issue the citation. We currently leave Fee Due Envelopes on
vehicles in the facilities at the end of the shift, but several people are
beginning to skip without paying.
The citation amount and citing method has been revie~nd approved by the City
Attorneys, Municipal Court, and Enforcement. A
ADMINISTRATIVE ORDER
of the
City Manager of the City of Eugene, Oregon
The City Manager of the City of Eugene finds that:
A. The City of Eugene charges a per hour rate on city operated off-
street public parking facilities from 7:00 a.m. through 6:00 p.m., Monday
through Saturday.
B. It is common that vehicles enter the lot during the set hours of
operation and leave after the end of those hours of operation.
C. City of Eugene Municipal Code 5.285(1) states:
"A motor vehicle parked on or in a non-metered off-street parking
facility provided by the city may not be removed from that facili-
ty by a person other than a representative of the city authorized
so to remove it, until the charge for the parking, as indicated by
a city-authorized public notice at the facility, has been paid to
the city or to a representative of the city authorized to receive
the payment."
D. City of Eugene Municipal Code 5.990(3) states:
"Violation of Sections 5.285, 5.385, 5.565, 5.575, 5.580, and
5.585 shall be punishable by a fine not exceeding $25.00."
E. City has posted the hours of operation, the parking fee schedule,
and that it is a violation of Municipal Code 5.285 to leave the city off-
street public parking facilities without paying.
F. Attendants leave "PARKING FEE DUE" envelopes on vehicles in the
facility at the end of the day's hours of operations to provide a method for
the vehicle operator to pay the parking fee. Vehicle operators are requested
to place the amount owed in the Parking Fee Due Envelope and leave it at the
envelope drop box located on each lot. The vehicle operator is given the
option of mailing the fee envelope to the City of Eugene Finance Division.
G. The bail amount has not been set for violation of Municipal Code
5.285(1).
H. The City Manager has the authority to set the bail amount, through
an Administrative Order, within the limits set by the Municipal Code.

NOW, THEREFORE,
The City Manager of the City of Eugene orders and directs that:
1. Based upon the above findings, which are adopted herein, the
established bail amount for violation of City of Eugene Municipal Code
5.285(1) is $10.00 per violation.
2. The registered owner of the recorded vehicle be allowed twenty
(20) calendar days to return the fee owed and the Parking Fee Due Envelope to
City.
3. After the 20 day period, if the fee owed has not been accounted
for, the City may issue a citation for the violation and mail that citation
directly to the registered owner of the vehicle. The citation will be
processed under existing Municipal codes.
4. The Parking Fee Due envelope will contain an explanation of the
fee due, the process for payment, and the possibility of receiving a citation
for non-payment.
5. The provisions of this Administrative Order does not affect any
other ordinances or bail amounts established prior to this date.
6. This Order shall become effective immediately upon recording by
the City Recorder's Office.
