Pursuant to the provisions of Section 3.247 of the Eugene Code, 1971, and Section R-3.25O-J of Solid Waste & Recycling Collection Administrative Rule R-3.250, the City Manager has authority to authorize additional licenses for the collection of solid waste within the City. B. Northwest Resource Recycling, Inc. has applied for a new solid waste collection license in order to collect industrial and commercial waste within the City, transport the same to a materials recovery facility outside the City, where recyclable materials will be removed prior to transporting the remaining waste to the County landfill. e. The applicant has represented that this service, which is not available from current licensees, is unique, and will result in a significant reduction in waste load. It is for this reason that it appears to be in the public interest to approve the application, subject to the terms, conditions and restrictions imposed therein. Therefore, based upon the above findings, which are adopted herein, The City Manager of the City of Eugene orders that: 1. A Solid Waste & Recycling Collection license, a copy of which is attached as Exhibit A hereto and incorporated herein by reference, is hereby granted to Northwest Resource Recycling, Inc. 2. The license shall become effective upon execution of a copy thereof by Northwest Resource Recycling, Inc., payment of applicable fees, and delivery to the City of any other documentation required thereby. (Licensee) is authorized by this license to collect industrial and commercial solid waste only within the City of Eugene, providing, the solid waste is transported to a materials recovery facility at 1680 Irving Road, Eugene, Oregon, all materials designated as principal recyclable materials for the Lane County wasteshed are removed therefrom, the remaining solid waste is thereafter transported to a Lane County landfill or waste transfer station, and this activity results in a significant reduction in the waste load. 2. In addition to compliance with the specific terms imposed herein, Licensee shall, throughout the license term, comply with all local and state land use, building code and environmental law requirements and secure and provide City with proof of any permits or licenses required thereby. A violation by Licensee of any of those requirements or laws shall constitute a violation of this license. 3. Licensee shall be subject to and agrees to comply with the City's solid waste and recycling collection Code and Rule provisions, specifically including the minimum/maximum rate schedule and the requirement to provide financial records and tax returns when requested to do so by the City for rate studies and license fee determination. 4. To substantiate the reduction in waste load, the Licensee shall submit to the City, on a quarterly basis: 4.1 The total number of its accounts; 4.2 A breakdown of accounts by container size; 4.3 The total amount of material collected, by tons; 4.4 The total amount of solid waste disposed, by tons; 4.5 The total amount of recyclables recovered, by tons. These items shall be verified by account records, weight slips and sales receipts. The quarterly reports and verification shall be submitted three months from the date this license is issued and every three months thereafter. A report thereof shall be delivered to the City within 30 days of completion of each quarter. 5. In addition to the reports required under paragraph 4 above, six months from the date this license is issued, and every six months thereafter, Licensee shall prepare an analysis substantiating the reduction in waste load. A report thereof shall be delivered to Exhibit A - License - 1 the City within 30 days of completion of each six month period. 6. Failure to submit a report as required in paragraphs 4 or 5 above shall result in a penalty of $100. Failure to submit two or more reports as required in paragraph 4 and 5 above during the course of one license year shall result in the City's not extending the license beyond the end of the same year. 7. The rights, privileges and license granted shall be for a continuing five-year term commencing the July 1 prior to license issuance, providing the Licensee notifies the City in writing by June 1 of each year that the Licensee elects to extend the license, and subject to the requirements of this agreement and other federal, state and local requirements. 8. Except for the first year, the aDDuallicense fee shall be assessed on the same basis as for all licensed Eugene haulers as outlined in the City of Eugene Solid Waste and Recycling Collection Rule R-3.250 - currently based on 2% of Licensee's gross receipts, less the tipping fee. The first year's license fee shall be paid in two parts; the first installment shall be $500, and must be paid before license issuance. The second installment for the first year's license fee shall be payable upon license renewal, and no later than July 1, 1994, and shall be the greater of: (a) $100, or (b) 2% of Licensee's gross receipts for the period beginning with license issuance and ending June 30, 1994, less the tipping fees for that same period and less the $500 installment payment. Application and license fees are not refundable. Failure of the Licensee to pay required application and license fees within 30 days notice of the amount thereof shall result in an automatic revocation of this license. 9. In addition to revocation under paragraph 8 above, this license may be revoked, terminated or suspended upon failure of Licensee to secure and comply with any required permits of any other governmental entity or failure to comply with any other term of this license, including ongoing evidence of a significant reduction in waste load.
