GRANTING A REVISED SOLID WASTE & RECYCLING
COLLECTION LICENSE TO NORTHWEST RESOURCE
RECYCLING, INC.
A. Pursuant to the provisions of Section 3.247 of the Eugene Code, 1971, and Section
R-3.250-J of Solid Waste & Recycling Collection Administrative Rule R-3.250, the City Manager
issued Administrative Order No. 53-93-21 on September 28, 1993 granting a new solid waste
collection license to Northwest Resource Recycling, Inc.
B. Northwest Resource Recycling, Inc. has requested a modification of the license to
reflect a change in the location of its materials recovery facility, and to permit it to subcontract
with Sweet Home Sanitary Service to transport residual waste from Licensee's facility to a state
approved landfill or transfer station. Other modifications should also be made at this time to
reflect changes in reporting requirements and license fees.
C. The services provided by the Licensee are beneficial to the community, and it is
in the public interest to modify the existing license.
Therefore, based upon the above findings, which are adopted herein,
The City Manager of the City of Eugene orders that:
1. A revised Solid Waste & Recycling Collection license, a copy of which is attached
as Exhibit A hereto and incorporated herein by reference, is hereby granted to Northwest
Resource Recycling, Inc.
2. The license attached as Exhibit A hereto shall become effective upon execution of
a copy thereof by Northwest Resource Recycling, Inc., payment of applicable fees, and delivery
to the City of any other documentation required thereby, specifically including a copy of
Licensee's agreement with Sweet Home Sanitary Service that has been approved by City.
3. The license granted by Administrative Order No. 53-93-21 shall remain in full
force and effect until Licensee has complied with the provisions of Section 2 above, and shall be
cancelled as of the effective date of the revised license attached as Exhibit A hereto.

Revised Solid Waste & Recycling Collection License
Northwest Resource Recycling~ Inc.
1. Northwest Resource Recycling, Inc. (Licensee) is authorized by this license to
collect industrial and commercial solid waste only within the City of Eugene (City), providing the
solid waste is transported to a materials recovery facility at 2034 West 2nd Avenue, Eugene,
Oregon, all materials designated as principal recyclable materials for the Lane County wasteshed
are removed therefrom, the remaining solid waste is thereafter transported to a state approved
landfill or waste transfer station, and this activity results in a mininum recovery of 40 % for
accounts collected with the Eugene City limits for the period from 1995 to 1999, and a minimum
recovery of 60 % for accounts collected within the Eugene City limits for the year 2000.
2. In addition to compliance with the specific terms imposed herein, Licensee shall,
throughout the license term, comply with all local and state land use, building code and
environmental law requirements and secure and provide City with proof of any permits or licenses
required thereby. A violation by Licensee of any of those requirements or laws shall constitute
a violation of this license.
3. Licensee shall be subject to and agrees to comply with City's solid waste and
recycling collection Code and Rule provisions, specifically including the minimum/maximum rate
schedule and the requirement to provide financial records and tax returns when requested to do
so by City for rate studies and license fee determination.
4. To substantiate the reduction in waste load, the Licensee shall submit to City, on
a monthly basis:
4.1 The total number of its Eugene collection accounts;
4.2 A breakdown of those Eugene accounts by container size;
4.3 The total amount of material collected, by tons;
4.4 The total amount of solid waste disposed, by tons; and
4.5 The total amount of recyclables recovered, by tons.
These items shall be verified by account records, weight slips and sales receipts. The monthly
reports and verification shall be submitted one month from the date this license is issued and every
month thereafter. A report thereof shall be delivered to City by the 10th day of each month.
5. Failure to submit a report as required in paragraph 4 above shall result in a penalty

of $100. Failure to submit two or more reports as required in paragraph 4 above during the
course of one license year shall result in City's not extending the license beyond the end of the
same year.
6. The rights, privileges and license granted shall be for a continuing five-year term
commencing the July 1 prior to license issuance, providing Licensee notifies City in writing by
June 1 of each year that Licensee elects to extend the license, and subject to the requirements of
this agreement and other federal, state and local requirements.
7. The annual license fee shall be assessed on the same basis as for all licensed Eugene
haulers as outlined in the City of Eugene Solid Waste and Recycling Collection Rule R-3.250 -
currently based on 5% of Licensee's gross receipts, less the tipping fee. Application and license
fees are not refundable. Failure of the Licensee to pay required application and license fees within
30 days notice of the amount thereof shall result in an automatic revocation of this license.
8. In addition to revocation under paragraph 7 above, this license may be revoked,
terminated or suspended upon failure of Licensee to secure and comply with any required permits
of any other governmental entity or failure to comply with any other term of this license,
including ongoing evidence of a minimum recovery of 40% for accounts collected within the
Eugene City limits for the period from 1995-99, and a minimum recovery of 60% for accounts
collected within the Eugene City limits for the year 2000.
9. Upon City's approval of any agreements therefore, Licensee may subcontract with
Sweet Home Sanitary Service to transport residual waste from Licensee's facility to a state
approved landfill or transfer station. Violation of a provision of this license by Licensee's
subcontractor shall constitute a violation by Licensee.
