Rescinding Administrative Order No. 53-94-15; Delegating
Duties Under Chapters 3, 6, 8, and 9 of the Eugene Code, 1971.
The Manager of the Building & Permit Services Division of the Planning &
Development Department of the City of Eugene finds that:
A. Abe Farkas, Director of the City's Planning and Development Department of the
City of Eugene, as the City Manager's designee, has by Administrative Order No. 53-96-00
delegated to me the duties and responsibilities to be performed by the City Manager under
Chapters 3, 8, and 9 of the Eugene Code, 1971, and the joint authority, to be coordinated with
the Public Works Director, to perform and carry out the City Manager's duties and
responsibilities under Chapter 6 of the Eugene Code, 1971, except:
1. The adoption, amendment, or repeal of any rules authorized therein;
2. The adoption, amendment, or repeal of any fees or fee schedules
authorized therein;
3. The City Manager's decision-making authority with respect to appeals
and determinations to implement legal proceedings on behalf of the City; and
4. The City Manager's enforcement duties and responsibilities under
Chapter 9 of the Eugene Code, 1971, delegated jointly with Jan Childs, Planning
Director by Section 3 of Administrative Order No. 53-96-00.
B. Administrative Order No. 53-96-00 further specifically authorized me to in turn
delegate any of the duties or responsibilities delegated to me therein.
C. Based on prior authorizations, I have previously issued administrative orders
delegating duties to others. In order to avoid confusion and ensure the efficient administration
of those duties, Administrative Order No. 53-94-15, and any other orders in conflict herewith
should be rescinded, and the duties and responsibilities delegated as hereinafter set forth.
NOW, THEREFORE,
THE MANAGER OF THE BUILDING AND PERMIT SERVICES DIVISION OF
THE PLANNING & DEVELOPMENT DEPARTMENT OF THE CITY OF EUGENE

ORDERS AND DIRECTS THAT:
1. The above findings are adopted.
2. Administrative Order No. 53-94-15 issued by me on October 13, 1994, and any
other order in conflict herewith are hereby rescinded, as of the effective date of this Order.
3. Except as set forth in Finding A above, the duties, responsibilities, and authority
delegated to me by the Director of Planning & Development as the designee of the City Manager,
to carry out the City Manager's duties and responsibilities under Chapters 3 and 8 of the Eugene
Code, 1971, the joint authority and responsibility to enforce the provisions of Chapter 9 of the
Eugene Code, 1971, including permits or variances issued thereunder, and the joint authority, to
be coordinated with the Public Works Director, to perform and carry out the City Manager's
duties and responsibilities under Chapter 6 of the Eugene Code, 1971, are hereby delegated to the
persons acting as the Building Official, Code Compliance Manager, Permit Review Manager,
Business License/Land Use Supervisor, and Inspection Supervisors.
4. Upon finding it would be more efficient and in the public interest to do so, any of
the duties and responsibilities delegated herein may in turn be delegated to such person or persons
considered qualified to perform the duties or assume the responsibilities.
5. The delegations of authority contained herein shall be construed to extend to and
include any person(s) "acting in capacity" (AIC) for the persons to whom authority is delegated.
