Emergency Rule Amending Emergency Rule Concerning
Application of Hazardous Piping Regulations in Construction of
Semiconductor Manufacturing Facilities Adopted by Administrative
Order No. 53-96-03, and Extending the Effective Date.
The City Manager Pro-Tem of the City of Eugene finds that:
A. Pursuant to the authority of Sections 2.019(6) and Chapter 8 of the Eugene Code,
1971, which authorizes the City Manager to adopt rules for the administration and enforcement of
provisions of the Eugene Code, 1971, specifically including regulations and policies relating to
construction requirements, on March 14, 1996 I issued Administrative Order No. 53-96-03 adopting
Emergency Rule Concerning Application of Hazardous Piping Regulations in Construction of
Semiconductor Manufacturing Facilities. That Rule requires the application of the 1993 Oregon
Mechanical Specialty Code, Appendix 24 to the review of hazardous piping and equipment
installations in semiconductor manufacturing facilities during the processing of building permit
applications and conducting construction inspections.
B. That Emergency Rule, which will expire on September 10, 1996, should be extended
for an additional 180-day period, during which time the rule will be reviewed and considered for
adoption as a permanent rule, or a determination made to repeal the rule.
C. On April 1 , 1996 the 1996 Oregon Mechanical Specialty Code became effective and
the former Appendix 24 is now Appendix Chapter 14 of the 1996 Oregon Mechanical Specialty
Code. The Rule should therefore be amended to require the application of the 1996 Oregon
Mechanical Specialty Code, Appendix 14 to the review of hazardous piping and equipment
installations in semiconductor manufacturing facilities.
D. During the effective period of this emergency rule as extended, review and
consideration shall be given to the effect of this regulation, the resources required to provide this
regulation, and what final regulations should be included in a final rule or whether the rule should
be repealed.
E. I find that adoption of this emergency rule is necessary in order to ensure that this
policy is continued to be strictly adhered to by the Building Official in considering applications for
development or construction of semiconductor manufacturing facilities using hazardous piping and
equipment.

F. Failure to extend the effective date of this rule could prejudice the effectiveness of
the City's programs relating to development or construction of semiconductor manufacturing
facilities using hazardous piping and equipment to the detriment of the public health and safety.
Therefore, based upon the above findings, which are hereby adopted, and pursuant to the
authority contained in Sections 2.019(6) and Chapter 8 of the Eugene Code, 1971,
The City Manager Pro-Tem of the City of Eugene hereby orders that:
1. The effective date of Emergency Rule Concerning Application of Hazardous Piping
Regulations in Construction of Semiconductor Manufacturing Facilities adopted by Administrative
Order No. 53-96-03 is hereby extended for a period of 180 days from September 10, 1996, unless
earlier repealed, or replaced with a permanent rule adopted in accordance with the procedures of
Section 2.019 of the Eugene Code, 1971.
2. The Emergency Rule as extended herein is amended to provide that the Building
Official shall require the application of the 1996 Oregon Mechanical Specialty Code, Appendix
Chapter 14 to the review of hazardous piping and equipment installations in semiconductor
manufacturing facilities.
