City of Eugene, Oregon
Delegating Authority to Act as "Person in Charge of
Premises" to City of Eugene Police Officers.
The City Manager of the City of Eugene finds that:
A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of
1976, the City Manager is designated as the administrative head of the City, and is
specifically authorized to appoint and remove all employees (except as otherwise provided
in the Charter), and to enforce all ordinances of the City.
B. The City is the owner of several parking structures within the City, and City
police officers frequently patrol those structures or are requested to respond to incidents
occurring therein. Some enforcement actions require the presence of, or action by a
"person in charge" of the premises, and it would be in the public interest to delegate that
authority to City of Eugene police officers.
NOW, THEREFORE,
THE CITY MANAGER OF THE CITY OF EUGENE ORDERS AND DIRECTS
THAT:
Based on the above findings, which are hereby adopted, City of Eugene police
officers are hereby delegated authority to act on the City's behalf as a "person in charge
of premises" with respect to parking structures owned by the City. This authority is in
addition to, and not in lieu of, existing authority of other persons to act in such capacity.
