ADMINISTRATIVE ORDER NO. 53-98-13-F

ESTABLISHING INCREASED OFF-STREET PARKING
FEES AND REPEALING ADMINISTRATIVE ORDER NO. 53-97-09-F.
The City Manager of the City of Eugene finds as follows:
A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to
determine and set fees and charges to be imposed by the City for services, goods, use of
municipal property, and licenses and permits. In addition thereto, Section 5.040 of that
Code specifically authorizes the City Manager to establish parking areas, time limitations,
form of permissible parking, and fees therefor, subject to the maximum charges for off-
street parking in Subsection 5.285(5) and on-street parking meter rates in Subsection
5.335(1 ).
B. In accordance with the procedures set forth therein, and after considering the
applicable criteria of Subsection 5.050(n)6. and Subsection 5.285(7) of the Eugene Code,
1971, on November 12, 1998 I issued Administrative Order No. 53-98-13 proposing an
increase in the City's off-street parking fees set forth in Section A.1. of the Parking Fee
Schedule and Regulations attached as Exhibit A to Administrative Order No. 53-97 -09-F,
effective January 1, 1999 as set forth in the Notice of Intended Fees attached as Exhibit
A thereto and incorporated therein by reference.
C. The Notice was provided to the Mayor and City Councilors, posted at two
locations at City Hall on November 12, 1998, and made available for inspection by
interested persons at the office of the City Manager, City Hall, 777 Pearl Street, Eugene,
Oregon, during normal business hours (8:00 a.m. to 5:00 p.m.. Monday through Friday,
exclusive of holidays). In addition thereto, copies of the notice were placed on vehicles in
the affected parking facilities on November 12, 1998.
D. The notice provided that interested persons could submit written comments
thereon for a period of 15 days from the date of posting. Four written comments were
received, to which I make the following findings:
Comment 1: Correspondence from Mary Sheriff indicates that she does not
object to the rate increase as proposed but wants to make the City aware of certain
problems associated with the Overpark. She reports that her car has been broken
into twice this year, the facility was full on one occasion when she returned to park
in the facility, and the monthly card reader was not functioning for several weeks.
Findings: Inasmuch as the comments do not relate to the proposed rate
increases, no findings are required herein, and staff will respond directly to the

concerns raised by Ms. Sheriff.
Comment 2: David Wood expressed the following concerns:
2.1 The rate increase exceeds the rate of inflation with the rates being
raised twice in 1997 and twice in 1998;
2.2 The City parking facilities are in a state of disrepair and the City is not
using the revenues of the parking lots to make needed repairs;
2.3 The rate increase is discriminatory because there is no charge for car
pool parking and a reduced rate for swing shift workers;
2.4 Traffic is encouraged to come into the City by the $3.00 charge for
event parking and a similar privilege of a low rate should be offered to downtown
workers;
2.5 The City is placing an unfair financial burden which is a tax for driving
to work;
2.6 The City of Eugene is making a fortune from parking facilities and
parking meters in the City; and
2.7 The increases are extreme and injurious to the working class of the
area.
Findings: The overall rate increase is 2.60/0 which is consistent with the rate
of inflation for the 1998 calendar year. The rates were raised in January 1997 and
then again in January 1998. There were no other rate increases in 1997 or 1998.
Parking rate increases are intended to keep pace with inflation as it affects the
various expenditures associated with operating and maintaining the parking
facilities, such as security, fee collection, custodial services, and utilities. Net
revenues are used to repair and improve the parking lots and a number of
improvement projects are scheduled to be undertaken in 1999. Free carpool
parking is intended to provide incentives to individuals to ride together in groups of
three or more in order to reduce traffic congestion and improve air quality. While
the event parking rate is $3.00 per day, the highest monthly parking fee is only
$1.58 per day. The reduction in rates for swing shift workers is to provide incentive
for them to park in the off-street facilities to make more space available on-street
for evening customers in the downtown area; there currently is minimal utilization
of City off-street parking facilities after daytime hours. The monthly parking rates
in the downtown area are lower than most larger cities and comparable or lower to
cities of similar size in this region. The revenue earned from the parking facilities is
used to cover operating expenses and is adequate to meet some necessary capital
improvement expenses but not all. It takes years to accumulate enough revenue
for some of the larger projects.
Comment 3: GiI Achterhoffs correspondence indicates that he does not
oppose the rate increase but objects to the rideshare rates not being increased and
notes observations of rideshare permit vehicles arriving to park in the EPAC garage
with only the driver in the vehicle.
Findings: The City's Rideshare Program is intended for individuals who are

willing to earn the privilege by bonafide efforts required to assume the responsibility
of sharing the ride to work on a daily basis with two or more other commuters. The
program is mandated by the City Council to reduce the number parking spaces
downtown, to reduce the number of cars on the streets each day to reduce traffic
congestion, and to improve air quality. The Rideshare program requires that the
rider be present in the vehicle for at least 800/0 of the commute trip but does not
require the rider to be in the vehicle and accompany the driver to the facility. The
City is planning a rideshare permit re-application and verification process after the
first of the year to eliminate any abuses.
Comment 4: Sabree Hammel indicated that she is very concerned about pot
holes in Lot 15 where she is a monthly parker. She also questions the need for the
rate increase and whether the City really wants downtown workers to be able to
park downtown. She refers to family requirements of individuals which preclude
them from taking the bus.
Findings: The findings in response to comment 2 are responsive to Ms.
Hammel's question concerning the rate increase. City staff has been requested to
respond direct to Ms. Hammel with respect to the other concerns she raised.
On the basis of these findings, and the findings contained in Administrative Order
No. 53-98-13, no changes are being made in response to the comments received, and,
The City Manager of the City of Eugene orders that:
1. Administrative Order No. 53-97 -09-F, and any other order in conflict
herewith, is hereby repealed, as of midnight, December 31, 1998.
2. The Parking Fee Schedule and Regulations attached as Exhibit A hereto and
incorporated herein by reference is hereby adopted and/or ratified, effective January 1,
1999.

*Broadway Place South and Broadway Place North garages are
scheduled to open between February 1999 and June 1999. These
rates will apply to the new structures upon opening.
**The surface lots at Broadway and Lincoln, Municipal Lot Numbers
21 and 31, are the site of the new Broadway Place garages. The
temporary relocation of the monthly parkers and the related monthly
rate will be canceled upon the opening of the new facilities.

3. Off-Street Parking - Restrictions and Exceptions:
3.1 Except for Special Event permits, and except on legal holidays as defined in
ORS 187.010 (which includes Sundays), the permits and/or other fees set forth in Sections
1 and 2 are required when parking between the hours of 7:00 a.m. and 6:00 p.m. If a
holiday (other than Sunday) falls on Sunday, the succeeding Monday shall be a legal
holiday. If a holiday falls on Saturday, the preceding Friday shall be a legal holiday. A
Special Event permit shall be required for any day of the year, including those hours after
6:00 p.m. and holidays (including Sunday).
3.2 Notwithstanding the fee required under Section 2 above for non-metered off-
street parking facilities, no fee is required for the first hour a vehicle is parked in a non-
metered parking space in Lot 23 (Overpark) and Lot 35 (Parcade).
3.3 A validation coupon, which represents one hour of parking, will be accepted
by the City from a vendor at 500/0 of the then current hourly rate for parking at designated
off-street parking facilities.

3.4 A bulk purchase discount is provided for monthly parking and rideshare
permits based on the following:

The above rates apply when parking a vehicle in a metered on-street parking space
identified in the Meter Inventory maintained by the City's Traffic Engineer between the
hours of 7:00 a.m. and 6:00 p.m., except on legal holidays as defined in ORS 187.010
(which includes Sundays). If a holiday (other than Sunday) falls on Sunday, the
succeeding Monday shall be a legal holiday. If a holiday falls on Saturday, the preceding
Friday shall be a legal holiday.
