SUBJECT: ADMINISTRATIVE RULES FOR CITY ORDINANCE 5.240 and 5.540 -
SIGNING ON PRIVATE PARKING FACILITIES
Attached is an administrative order designating the police chief as the
administrator of rules pursuant to the new ordinance provisions effective
June 23, 1984.
The administrative rules were developed with two objectives in mind. First,
to make the notice of restricted parking similar to signs used by the
City in the parking enforcement program. This may help the public
recognize that parking is restricted on a parking facility.
The second objective is to allow enough flexibility in the rules to
accomodate most signs that currently exist. with the exception of the
grey and white signs that are in use, most signs could be used in their
present form by adding the hours of enforcement and the city Code section.
Public testimony on the ordinance indicated the grey legend on white
background size was developed to "blend in" with the adjacent buildings.
This appears to represent a contradiction with the purpose of posting
notice and was, therefore, excluded as an acceptable notice.
Other than the grey legend size, the department estimates that 90% of
all currently legal signs will be acceptable after minor modification
under the new rules.
It is also important to recall that only those parties wishing to use
the citation option will need to put up conforming signs immediately.
All other property owners have until July 1, 1985, to bring their signs

Section 5.540 of the Eugene Code, 1971 requires that parking
facilities have notice of parking restrictions posted before
citing or towing unauthorized vehicles therefrom, and establishes
standards therefor.
Under Subsection (2) of that Section, the City Manager,
or the Manager's designee, is directed to prescribe standard
signs containing wording that meets the requirements imposed
therein.
Section 5.540 further provides, in Subsection (3),
that the City Manager or the Manager's designee may approve
size and lettering modifications to the approved standard signs.
The City's Police Department will be primarily responsible
for enforcement of the signing regulations and should therefore
be designated to develop the standards and procedures for vari-
ances therefrom.
NOW, THEREFORE,
Based upon the above findings, and pursuant to the authority
contained in Section 5.540 of the Eugene Code, 1971, as City
Manager of the City of Eugene, Oregon,
IT IS HEREBY ORDERED:
1. The Police Chief of the City of Eugene is hereby directed,
as my des ignee, to prescr ibe standard signs wi th wording that
meets the requirements of Subsection (1) of Section 5.5413 of
the Eugene Code, 1971 for signs required to be posted upon parking

facilities before unauthorized vehicles may be cited or towed
therefrom.
2. The standard signs shall be designated in an Administra-
tive Rule of the Police Chief, which Rule shall be effective
on June 23, 1984.
Immediately upon its adoption, however, the
Police Chief shall cause public notice to be given of the proposed
standards by one publication thereof in a newspaper of general
circulation within the City.
The notice shall further state
that a public hearing will be held thereon within l0 days of
the date of the notice, and that a copy thereof may be obtained
at the Police Department upon payment of the normal fee charged
by the City for copies of public records. A copy shall also
be forwarded to local towing companies and other parties who
have expressed interest therein. Upon conclusion of the hearing,
and providing the standards are found in compliance with the
provisions of Section 5.540 of the Eugene Code, 1971, the Rule
shall be declared permanently effective.
3. Except where an emergency requires immediate action,
any mod if i ca t i on to the standard sign adopted under paragraph
2 hereof shall be adopted after similar notice and hearing.
4. The Police Chief is further directed to establish
in the Administrative Rule procedures for granting variances
to the standard signs, and procedures for modifying the standards
established by the Police Chief.
