ADMINISTRATIVE RULE
ESTABLISHING STANDARDS FOR SIGNS ON PARKING FACILITIES
Pursuant to the authority of Section 5.540 of the Eugene
Code, 1971, and as the designee of the City Manager of the City
of Eugene under an Administrative Order issued June ~, , 1984,
the following rules establishing signing standards, variance
procedures, and procedures for modifying the standards are hereby
adopted.
1. Signs required by Section 5.540 of the Eugene Code,
1971 must comply with the size and location requirements set
forth therein, and the following:
A.
Design.
Signs shall meet the minimum special
sign specifications for legends of type "c" as described
in City of Eugene Public Works Standard Sign Specifications.
The background of signs must be whi te, and the legend may
be in dark red, dark green, dark blue, or black.
B. Erection.
(1) A sign shall be erected so that the face
thereof is vertical.
(2) The sign shall be permanently affixed in
a manner and location that will leave it unobstructed
from view, readily noticeable, readable as required,
and at an elevation of between four (4) and nine (9)
feet from the bottom of the sign to the pavement or
ground.

c. Wording.
(I) Signs for those parties who elect to enforce
the prohibition on unauthorized parking by having
vehicles towed only, shall contain the following langu-
age:
PRIVATE PARKING*
Reserved for
UNAUTHORIZED VEHICLES TOWED AT OWNER'S EXPENSE.
ENFORCED ([24 hours] [9 a.m. to 5 p.m weekdays] [ect.]
Section 5.24& of the Eugene Code, 1971.
(*or equivalent language clearly indicating that it
is private property, reserved for a particular person/
use, and not public parking)
(2) Signs for those parties who elect to enforce
the prohibition on unauthorized parking by having
vehicles cited or towed, shall contain the following
language:
PRIVATE PARKING*
Reserved for
UNAUTHORIZED VEHICLES CITED OR TOWED AT OWNER'S EXPENSE.
ENFORCED ([24 hours] [9 a.m. to 5 p.m. weekdays] [etc.]
Section 5.24& of the Eugene Code, 1971.
(*or equivalent language clearly indicating that it
is private property, reserved for a particular person/
use, and not public parking)
2. Variance Procedures.
A. Upon written application therefor, the Chief

of Police may grant a variance as to the size of the sign, the
manner of erection, and the wording contained thereon, providing:
(1) The applicant demonstrates compliance would
create an unnecessary hardship in the particular in-
stance;
(2) Compliance is not feasible because of the
size, configuration, or other elements present on
the premises to be signed; and
(3) The requested variance would continue to
provide reasonable notice of the parking restrictions
to vehicle operators seeking a place to park.
B. The applicant shall submit with the application
a detailed statement of the variance requested and the reason(s)
therefor.
c. Upon receipt of the application, the Chief of
Police shall cause an inspection to be made of the premises
for which the variance is requested, and shall make a determina-
tion thereon within ten (10) days thereafter. The Chief of
Police may grant the variance as requested, or may condition
or modify the request, upon affirmative findings under subpara-
graph A above and that the signing is otherwise in compliance
with the purpose and intent of Section 5.540 of the Eugene Code,
1971 and other provisions of this Rule, or may deny the request.
D. The decision on the variance request shall be
in writing, shall state the reasons therefor, and shall be mailed
to the applicant at the address shown on the application. The

decision of the Chief of Police is final.
3. Modification of Rules.
A. These Rules may not be modified except in an
emergency situation without the Chief of Police first giving
notice of the proposed modification by publication in a newspaper
of general circulation within the City and affording the public
an opportunity to comment thereon. The notice shall contain
a statement as to the proposed effective date of the modified
Rule, which shall be at least ten (l0) days after the date of
publication, advise that a copy may be obtained at the Police
Department upon payment of the fee normally charged for copies
of public records, and indicate the date of the public hearing
thereon.
B. At the time specified in the notice, the Chief
of police, upon finding the proposed modification to be consist-
ent wi th the purpose and intent of Section 5.540 of the Eugene
Code, 1971, shall adopt the Rule.
C. If the Chief of Police finds that an emergency
exists necessitating the immediate adoption of a modification
to these Rules, he may declare the modification a Temporary
Rule, immediately effective pending a hearing thereon as pro-
vided in A and B above. At the conclusion of the hearing, the
Temporary Rule may be declared a Permanent Rule by the Chief
of Police.
4. Compliance. I n order to comply wi th the provisions
of Section 5.540 of the Eugene Code, 1971, signs must be in

conformity with the standards set forth in that section and
the provisions of this Rule, unless a variance has been granted
as provided for herein.
The foregoing Rule adopted the Z/srday of June, 1984,
temporarily effective June 23, 1984, and permanently effective
Jul-y -2-, 1984.
