BEFORE THE CITY MANAGER OF THE CITY OF EUGENE
ADMINISTRATIVE ORDER
The City Manager of the City of Eugene finds as follows:
1. As part of the community Response Team, the City of Eugene
proposes to contract with Whitebird Clinic for the performance of
services.
2. These services include placing into protective custody and
transporting visibly intoxicated persons who are either
incapaci tated, whose health is in immediate danger, or who are
dangerous to self or to any other person.
3. ORS 426.470 confers a limited immunity for peace officers
who are performing these functions. There is a need to minimize
the potential liability of the city of Eugene and Whitebird
personnel who are engaged in the performance of these services.
Commissioning affected personnel performing these functions will
allow better control by the city and insulate the City and its
agents from some types of liability.
Now, therefore, on the basis on the above findings, IT IS ORDERED
THAT:
1. The position of "Transportation Officer" is hereby create.d
to exercise the police functions set forth at ORS 426.460 (1) ·
Prior to any person engaging in those functions on behalf of the
City of Eugene, the person shall be commissioned by the Chief of
the Department of Public Safety as a special police officer to
exercise only those police functions set forth at ORS 426.460(1).
2. Any such delegation of authority shall be revocable at will
and shall not authorize the Transportation Officer to exercise
any other police function or to carry a firearm in the
performance of those duties. The position shall not be a full-
time position and may not be held by regular employees of the
City of Eugene. Any Transportation Officer shall not receive
compensation from the City of Eugene. A Transportation Officer'
shall be subject to orders and directions from any Eugene police
officer.
