AN ORDINANCE CONCERNING COMMERCIAL ZONING DISTRICTS AND
OFF-STREET PARKING REGULATIONS; AMENDING SECTIONS .2.407,
7.180, 9.060, 9.254, 9.268, 9.270, 9.392, 9.406, 9.420,
9.434, 9.504, 9.510, 9.534, 9.540, 9.542, 9.544, 9.546,
9.556, 9.558, 9.582, 9.584, 9.58G, 9.587, 9.590, 9.592,
AND 9.593 OF THE EUGENE CODE, 1971; REPEALING~SECTIONS
9.394, 9.395, 9.398, 9.408, 9.410, 9.422, 9.424, 9.436,
AND 9.438.OF THAT CODE; ADDING NEVI SECTIONS 9.437, 9.439,

THE CITY OF EUGENE DOES ORDATN AS FOLLOWS:
Section 1. Subparagraph ~h} of Section 2.407 of the Eugene Cade, 1971,
is hereby amended to read and provide r
2.407 Historic Landmark Desi nation -Criteria and Procedure. Hi stari c
landmarks shall be designated in the following manner;

Section 2. Subsection ~b}1. of Section 7.180 of the Eugene Code, 1971,
is hereby amended to read and provide:
7.1$0 Local Im ravements ~- A ortionment of Assessments. 1~hatever
share of the total costs of the improvement the council decides,
on the basis of previously stated policy, is to be borne by the city shall
be excluded from the assessment before apportionment. Special costs or
features of the improvement that benefit a particular parcel of property
in a manner peculiar to the parcel shall, together with a share of the
overhead for the improvement, be assessed separately against that parcel.
The remainder of the costs of the improvement, its general casts, together
with the overhead. far the improvement, shall be assessed against the
property as follows:

Section 3. Subsection ~1~~a~3. of Section 9.064 of the Eu ene Code

Section 4. Section 9.254 of the Eugene Code, 1971, is amended by delet-~
ing therefrom the definitions for "Automobile sales", "Motor vehicle, mobile
home and recreational vehicle sales area"; adding in alphabetical order
therein definitions for "Automobile", "Blood bank", "Mobi1e attended collec-
tion center", and "Truck, light"; and amending the definitions contained
therein far "Trailer", "Mobile home" and "Recreational vehicle", all to read
and provide:
9.254 Definitions. For purposes of sections 9.254 and 9.988 the state
statutes, rules, and regulations pertaining to mobile homes,
mobile home accessory buildings and structures, and mobile home parks,
which definitions are adopted herein by reference, the following are defined
as indicated; provided, however, that far purposes of sctions 9.488 to
9.491 the definitions in section 2.405 sha11 prevail if in conflict with
the definitions i n this section

Automobile. Private passenger car.
Blood Bank. An organization that accepts human whole blood,
donated voluntarily, and for which no financial compensation is
received.
Mobile attended collection center. A temporary, portable
structure or trailer placed on or near private parking areas by
charitable non-profit organizations to collect used household
goods, clothing, or other useful materials.
Mobile home. A vehicle ar structure that ~1~ is identified
as a mobile borne by the manufacturer, ~2} bears a state mobile
home insignia, ~3~ is constructed for movement on public roads
and highways, ~4~ has sleeping, cooking, and plumbing facilities,
~5~ is intended for human occupancy, and ~6~ is intended for
residential use.
Recreational vehicle, A vacation trailer or other unit with
or without motor power that ~1} is identified as a recreational
vehicle by the manufacturer, ~2~ bears a state recreational vehicle
insignia, (3} is designed far human occupancy, ~4} is to be used
temporarily far recreational purposes, and ~5} has a floor area of
less than 224 square feet including bathrooms and built-in equip-
,meet such as, wardrobes, closets, cabinets, and kitchen units,
Trailer vacation. See recreational vehicle.
Truck, li ht. A truck of one-tan capacity or less and not
bearing a state recreational vehicle insignia.
Section 5. Section 9.26$ of the Eugene Code, ~97~, is hereby amended
by repealing subparagraph (d) therefrom, relettering subparagraphs (e) and
(f) to (d) and (e), and amending subparagraph (a) thereof, to read and
pravide~
9.268 Establishment and Desi nation of Use Districts and Sub~Districts.
1n order to classify, regulate, restrict and segregate the uses
of lands and buildings, to regulate and restrict the height and side of
buildings, to regulate the area of yards and other open spaces about
buildings, and to regulate the density of population, the following classes
of use districts and sub-~di stri cts are established:

I . Sub~-di stri cts of each of the residential districts
may be established provided housing as needed by all income
groups can still be accommodated at appropriate locations
throughout the city. The parent residential district
requirements sha11 apply to the respective sub-districts
except those regulations pertaining to lot area per dwelling
unit or density. Suffix numbers, including but not limited

3. Previously established sub-districts described in terms
of the minimum square foot lot area required per family shall
shall hereafter be described in accordance with this section.

subject to inundation by flooding or by surface water. The
purpose of this sub-district is to minimize property loss, danger
of injury, and to reduce any potential health hazards. To
accomplish the purpose of this sub-district, i t i s necessary to
establish special building permit procedures and special building
requirements with respect to minimum finished floor elevations
and drainage provisions. Permitted buildings and uses allowed ar
conditionally allowed in each parent zone are permitted as
hereafter specifically provided for in sections 9.644 to 9.646
of this ordinance. Amendments to the zoning flood hazard sub-
district area shall be made in the same manner provided for in
sections 9.668 to 9.686,

hrough 6.694, a sub d~str~ct may be created w~th7n
any district listed in this Comprehensive Zoning Ordinance when
considered necessary according to the purpose for site review as
stated in section 9,686. The sub-district shall be designated by the
suffix "SR" added to the symbol of the parent district. A11 uses
permitted in the parent zone shall be allowable in this site review
sub-district; provided, however, that a site review approval must be
secured by the proper procedures prior to the issuance of a building
permit for construction in this sub-district.
Section 6. Section 9.274 of the Eugene Code, 1971, is hereby amended by
adding a new subsection ~3} thereto, to read and provide:
9.274 Elimination and Reclassification of Districts.
~3} The following district classifications existing prior to
August 8, 1984, are eliminated and repealed, and an said date any land
or property subject to said district classifications is reclassified to the
district classification designated herein:

Section 7. Sections 9.392. 9.446, 9.424 and 9.434 of the Eugene Code,
1971 are hereby amended; Sections 9.394, 9.396, 9.398, 9.408, 9.410, 9.422
9.424, 9.436, and 9,438 are hereby repealed, and new Sections 9.437, 9.439
and 9.440 are added thereto, to read and provide:
General Office District
9.392 General Office District - Descri tion and Pur ase. GO General

Office District regulations are primarily intended to pravi de for
small to medium-sized office buildings, often in transitional locations be-
tween residential and commercial uses. Developments must be compatible with
nearby residential uses in terms of scale, bulk, building and parking cover-
age, traffic generation, and other external factors. This district also
encourages a compatible mix of dwellings and offices on the same or adjacent
properties.
Commercial Districts
Descri bons and Pur oses
9.40 C-1 Nei hborhood Commercial District. C-~ Neighborhood Commercial
District regulations are primarily intended to serve the day-to-
day needs of a small support population, typically an adjacent residential
neighborhood. Uses may occur independently on individual lots or parcels or
as a cluster of small scale uses, but they often associate with a supermarket
as the principal use in combination with a cluster of complimentary conven-
ience and personal service establishments sharing common arkin facililties.

This district can also provide for housing when combined with commercial uses
ar structures on the same development site. A select list of uses not neces-
sarily oriented to daily consumer needs, but similar in size and external
operating character to convenience commercial and personal service uses,
are also included in the C-~ District,
9.420 C-2 General Commercial District. C-2 General Commercial District
regulations are primarily .intended to provide a wide range of pur-
chaser goads and respond to entertainment, office, and service needs for a
support population smaller than that of the metropolitan area, but larger
than that of a neighborhood. Housing combined with commercial uses or struc-
tures on the same development site is also permitted in this district. Es-
tablishments may occur independently on individual lots or parcels, but are
usually adjacent to other commercial uses. They may also locate in clusters
that share parking facilities and other common areas.
8.434 C-3 Major
Commercial District. C-3 Major Commercial District regu-
lations are primarily intended to provide a side range of purchaser
goods, educational opportunities, entertainment, offices, travel accomoda-
tions, and services that attract people from the entire metropolitan area,
Lane County, and adjacent counties. The application of this district is
therefore limited to:

floor area in retail sales, offices, and related uses normally
associated with retail sales, and
3. At least 84,000 square feet of the 300,000 square

feet occupied by a single retail store.
In addition, the central business district provides for government and admin-
istrative services, cultural facilities of regional significance, outdoor
recreation, special civic events, small scale manufacturing often combined
with on-site sales, and multiple family dwellings.
9.437 C-4 Commercial Tndustrial District. C-4 Commercial-Tndustrial
. District regulations are primarily intended to provide for automa-
b~le-oriented, commercial uses and complimentary processing, assembling,
packaging, or repairing of previously manufactured products, This district
is limited to areas designated Strip or Street-Oriented Commercial in the
Metropolitan Area General Plan,. It is further limited to development sites
with direct frontage on arterials. Those development sites must also be
located in areas already characterized by a mix of commercial and industrial
establishments.

1. The Building Official shall determine if uses similar to the above
in terms of district intent, operating characteristics, building bulk and
size, parking demand, customer types, and traffic generation are to be per-
mi tted, permitted conditionally, or prohibited i n the district requested.
2. In all but the C-4 Qistrict, all uses except those normally associ-
ated with outdoor displays, storage, or operations, such as automobile sales,
craft markets, garden supply centers, & service station pump islands, shall
be in entirely enclosed buildings unless otherwise approved in a conditional
use permit.
3. Administrative offices in the C-4 District that existed on August 8,
1984 are exempt from sections 9.612 to 9.626 pertaining to non-conformin
g
uses. This exemption is limited to development sites on which the adminis-
trative offices existed on August 8, 19$4.

Special Standards
9.440 S eci al Standards. Tn addition to general provisions, parking,
. and other regulations required by this code, the fallowing uses
are subject to the special standards set forth in this section:

tricts, and 40 feet within 50 feet of R-3 districts. Also, the height

first five feet above the ground. If the area between the PL zoned parcel

vehicle sales area, shall be improved according to the following:

shall be enclosed along interior property lines that abut those
residential districts with a 75 percent opaque site-obscuring
fence, wall, or hedge three to eight feet in height. The fence,
wa11 or hedge shall adhere to the visual clearance and front and
interior yard requirements of the district i n which i t i s l orated.
If it is not located on the property line, the area between the
fence, wa11 or hedge and the property line sha11 be landscaped
with lawn or low-growing evergreen ground cover, or vegetable or
or rock mulch. A11 plant vegetation in this area sha11 be ade-
quately maintained by a permanent irrigation system, and fences,
walls and hedges shall be maintained in goad condition. Plantings
shall provide the required degree of screening within ane year of
installation, Adequate provision shall be maintained to protect
walls, fences and plant materials from being damaged by vehicles
using the parking area.
Section 23. Section 9.593 of the Eugene Code, 197I, is hereby amended
by amending the title; amending Subsection ~I}~a}; and adding a new Subsec-
tion ~3} thereto, to read and provide:

except those located in I-2 or I-3 zoning districts, shall be buffered
from abutting streets uti 1 i zi ng such materials, design and characteristics
as necessary to conform to all the following requirements:
~a} Except as provided elsewhere in this Code for vision
clearance, and as is necessary for safe entrance to and exit
from parking areas, the minimum height is established as two-and-
one-half feet above grade within one year of installation; and
~3} The building official may approve the location of all ar
part of this section's required buffering in the public right-of-way pro-
vided:
~a} Adequate area exists to fulfill all the requirements
of subsection ~1} of this section between the property line and
the actual street;
fib} The street is already built to the planned right-of-
way width; and,
(c} Ali si on clearance requirements of this code are met,
