AN oRDINANCE CONCERNING TREE PRESERV'ATIQN;
AND AMENDING SECTIONS 3.600, 6.310, 6.330
AND 6.9 9 0 CF THE EUGENE CODE , 19 7 l .
THE CITY of EUGENE DOES ORDAIN A5 FGLL4wS;
Section 1. The definition of "occupied parcel" set forth in
Section 6.340 of the Eugene Code, 1971, is hereby amended to read
and provide:
6.300 Definitions. As used in sections 6.345 to 6.330 of
this code, the fo~.lowing definitions apply:

in the Lane County, Oregon ad valorem tax records with
one or mare dwellings thereon, ar a parcel which has
been approved far a dwelling.
Section ~. Subsection [1} ~.a~_ of Secta,on 6.310 of the Eugene
Cade, 1971, is hereby amended to read and pxov~.de:
6.310 P~cacedure of obtaining Tree Felling Permit.
~1} Application for a permit to fe7,1 a tree or trees
shall be filed with the parks department on a form prescribed
by and available in that department containing;
~:a} Date, name, address and telephone number of
the applicant; species or other description of the
tree ~:s } , their location on the property, and the rea-
son for felling; and plot plan showing trees to be re-~
moved and sizes; and
Section 3, Subsection ~.h} of Section 6.330 of the Eugene Code,
1971, is hereby amended to read and provide:
6.334 Trees, Fellin - Exce bons. The requirements and res-
trictions of sections 6.305 to 6.310 of this code do
not apply to:
~h} within that portion of a PUD and/or PUD sub-
division development far which final approval has been
obtained.
Section 4. Subsection ~3~. of Section 6.990 of the Eugene
Code, 1971, is hereby amended to read and provide:

6.994 Penalties - S ecific.
t3~ Violation of section G..3p5 to and including sec-
tion 6..314 is punishable by a fine of a minimum of $144 to a
maximum of $4,404 for each tree removed, ar confinement in fail
not to exceed 144 days, or both fine and imprisonment. In
addition, the city attorney, upon request of the city manager,
shall institute any necessary legal proceedings to enforce the
provisions of sections 6.345 and 6.314 of this code.
Section 5. The Council directs that the foregoing penalty pro--
visions be enforced in a manner that serves to deter violations of
section 6.345 to and including section x.314. The amount of an fine

imposed for such violations must be sufficient in amount so as to make
unlawful tree felling uneconomical in light of the replacement value
of such timber.
