AN ORDINANCE C~?NCERNING TAx EXEMPTION FoR MULTIPLE-~UNIT RENTAL HOUSING WITHIN A DESIGNATED AREA; AMENDING SECTIONS 2.945 AND 2.947 CF THE EUGENE CODE, 1971; AND~DECLARING AN EMERGENCY. THE CITY QF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Subseotions ~ 1 } and ~.2 ~_ of Section 2.9 45 of the Eugene Code, 1971, are hereby amended to read and provide: 2.945 Multi le-Unit Rental Housin -Pro erty Tax Exemption. ~l~ Based upon the findings contained in Resolution No. 211 adopted by the council on duly ll, 1977, and the pro-. visions of Resolution No. 3523 adopted by the council on May 27,_1981, the provisions of ORS 307.600 to 307.694 are hereby adopted as the city's multiple-unit rental housing property tax exemption program within the area generally bounded by the Southern Pacific railroad tracks on the North, Washington Street on the Vest, lath Avenue on the South, ~.nd on the East by High Street between 13th and 11th Avenues, thence East along 11th Avenue to Patterson Street, thence North to Broadway, thence West and North along Broadway to the Ferry Street bridge, all of which is more particularly described in Exhibit "A" to Reso- lution No. 3523 referred to above. ~2~ Applications for property tax exemption hereunder shall be filed with the city's department of housing and communi- ty conservation and processed in accordance with the amended and restated standards and guidelines attached as Exhibit "B" to resolution No. 3523. Section 2. Subsections (a) and (b ). of subsection (l~ of Section 2.947 of the Eugene Code, 1971, are hereby amended to read and pro- vide: 2.947 Multiple-Unit Rental Housin ~- Termination of Ap roval, Review. ~l~ ~a} Construction of multiple-unit rental housing was not completed on or before January 1, 1955, and no extensions as provided in subsection ~4~ hereof have been granted, or ~b~.. The applicant has failed to comply with the provisions of ORS 307.600 to 307.690, the provisions of this. code, any provisions of the amended and re- stated standards and guidelines approved by resolution No. 3523, or Ordinance - 1 1~8a9 Section 3. Subsection (4~ of ~ecti~on ~.9~7 of the Eugene Code, 19?l, is hereby amended to read and provide: 2.94? Multi le-Unit Rental. Housing - Termination of Ap roval, Review. ~4~ Upon receipt of a request From the property owner, the council may, by resolution, extend the deadline for comple- tion of construction of multiple-unit rental housing for a period not to exceed 12 consecuti~re months, i~.e., January 1, 198G, if it finds the failure to complete construction by ~'anu- ary 1, 1985 was due to circumstances beyond the control of the owner, and that the owner had been and could reasonably be ex- pected to act in good faith and with due diligence. Section 4. The provisions contained herein concern the public welfare and, therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and apprawal by the Mayor, 7th day of May Approved by the Mayor this 27th day of May, 1981 c Council President, Acting Mayor ordinance ~ 2.
