Halvorson/Bennett- EV 81-3} THE CITY OF EUGENE ~DOE.S ORDAIN AS FOLLOWS Section 1, The City Council, of the City of Eugene herein ini- tiates the vacation proceedings vn its own authority without peti- tion o.r consent of the property owners, except as provided by statute, of the above described public utility easement. Section 2. A hearing shall be he;~d upon the proposal to vacate the public utility easement as herein prodded, and the hearing shall be held on the 29th day of July, 1981, at noon Pacific Daylight Time of said date, at the Council Chambers at City Hall, Eugene, Oregon, at which time a~.l persons will be heard upon objections ar sugges- tions with regard to the vacation, and at said time the Council will provide for the vacation of the public ut.l~.ty easement or deny such vacation, and in case the vacation is :made, will provide and make provision for any damages sustained by local assessment. Section 3. The City Recorder is hereby directed to immediately publish once each week for four consecutive weeks in a newspaper pub- lished in Eugene, Lane County, Oregon, notice of .the proposed vaca- tion. The notice shall give a description of the area to be vacated as herein set out; state the date when this ordina,nc,e was passed, the name of any petitioners petitioning for the vacation, and the date Ordinance - 1 18814 when the petition, together with any ob~ectans or reamonstrances which may be made in writing-and filed with the Recorder of the City of Eugene prior to the date of the hearing, will be heard and considered. Section 4. The City Recorder sha11 forthwith and within five days after the first publication of the notice post, or cause to be posted, at ar near each end of the proposed vacation a copy of the foregoing, which shall be headed "Notice of Public Utility Easement Vacation," and which notice sha11 be posted in at least two conspi~- cuaus places in or Qn th.e aa~ea proposed to be vacated.
