An Ordinance vacating the following described public utilit

easement and declaring an emergency ~ to--wit:
As described on Exhibit "A" attached hereto and

On the ZOth day of .May, 1981, the City Council of the City of
Eugene passed Ordinance No. 15791 setting a hearing to be held on
the 24th day of June, 1981, at the Council Chambers at Cit Hall,
Y
Eugene, Oregon, at which time and place protests and remonstrances
could be heard as to the proposed vacation of the above described
public utility easement.
Notice was duly and regularly gi~ren of the hearing and a hear-
ing was held pursuant to the ordinance at the Council Chambers at
City Hall, Eugene, Oregon, on the 24th day of June, 1951 at Noon

Pacific Daylight Time, and at said time and place the Council heard
all objections.
All persons owning property abutting upon the public utility
easement to be vacated have consented to the vacation and applied
for the same.
THE CITY OF EUGENE. DOES ORDAIN AS FOLLQwS:
Section 1. The City Council of the City of Eugene finds that
due and regular notice of the hearing was published and posted as
by law required and no valid objections have been made at the hear-
ing or filed. The consent of the owners of the abutting pro ert

has been duly and regularly filed in the proceedings and the ublic

interest will not be prejudiced by the vacation of the ublic utilit

easement.

The hearing was held on the 24th day of dune, 1981,
at noon, Pacific Daylight Time, at the Council Chambers, City Hall,
Eugene, .Lane County, OregonR and all matters necessary to be done in
the premises have been duly and regularly completed.
Section. 3. The herei~nabove described public utility easement
is hereby vacated, and the public utility easement so vacated shall
revert pursuant to the statutes of the State of Oregon.
Section 4. The City Recorder is hereby directed to file a cer-
tified copy of this Ordinance with the Recorder of Lane Count ,
Y
Oregon, together with a map or plat of said property, and a certi-
fied copy of this Ordinance shall be filed with the Lane Count
Y
Assessor and another certified copy shall be filed with the Lane
County Surveyor.
Section 5. The easement vacated herein was erroneously placed
upon the subdivision plat and not corrected prior to recording.
Plans for development of th.e parcel h.a~re ,been delayed because of
the need to correct the error, .and the applicant submitted the vaca-
tion request in early :February, 19 81. ~'t~rth~er delay in of fectin

the vacation w-ill create undue hardship for the propert owners

will not be in the best public interest and welfare, and, therefore,
an~emergency is hereby declared to e;xist and this ordinance
shall
become effective immediately upon its passage by the City Council
and approval by the Mayor.

Judson, as platted and recorded on File l3, Slide Z71, Lane County
Plat Records, Lane County, Oregon;
thence South 89° 55' 30" West 35 feet to the true paint of beginning;
thence North 30 2' 21" East llo feet more or less, to a point which
is the common lot line of Lots 1 and 2 of said Block 2 of Judson;
thence North 310 ~o' 19" West 71 feet, more~or less, to a point on
