City of .Eugene Ev 81-- ~ THE CITY QF EUGENE. DGES 4RDALN As FaLLowS: Section 1. The City Council of the City o~ Eugene herein ini- tiates the vacation proceedings on ,its own authority without peti- tion or consent of the property owners, except as prov~.ded by statute, of the above described public utility easement, Section 2. A hearing shall be he~.d upon the proposal to vacate the public ut~;lity easement as herein provided, and the hearing shall be held on the nth day of September, 198., at noon Pacific Daylight Time of said date, at the Council Chambers at City Hall, Eugene, Qregon, at which time all persons will be heard upon objections ar suggestions with regard to the vacation, and at said time the Council will provide for the vacation of the public utility easement or deny such vacation, and in case the vacation is made, will provide and make provision for any damages sustained by local assessment. Section 3, .The City Recorder is hereby directed to immediately publish once each week fox four consecut.we weeks in a newspaper pub- lished in Eugene, Lane County, Or-egon, notice of the proposed vaca- tion. The notice. shall ~a~ve a description o~ the area to be vacated as herein set .out; state the date when this ordinance was passed, the name of any petitioners .petitioning for the vacation, and the date when the petition, together with. any objections or remonstrances which may be made in writing and filed with. the- Recorder of the City of Ordinance ~- 1 18831 Eugene prior to the date of the hearingr will be heard and considered. Section 4, The City Recorder sha~,l forthwith and within five days after the first publication of the notice posh or cause to be posted, at or near each end of the proposed vacation a copy of the foregoing, which sha11 be headed "Notice of Public Utility Easement vacation " and which. notice sha,l~l be posted in at .east two conspi-- cuaus places in or on the area proposed~to be vacated. The posting a,nd the first day of publication of the notice shall be not less than ~twenty~~-eight ~28~ days before the time set for hear-~ inf.
