An ordinance initiating the vacation of the following described
alley, to-wit:
Beginning at the Northeast corner of Lot 1 of Overlook
-~ Addition, as platted and recorded in Volume 4, Page 9,
Lane County Oregon P~a,t Records, run thence North along
the West line of Augusta Street, 12 feet, thence West
parallel with the north line of overlook, l3~ feet,
thence South l~ feet to the North line of Overlook,
thence East 130 feet along the North line of Lot 1,
Overlook, to the point of beginning in Eugene, Lane
Y County, oregvn.
RESERVING herein public utility and bicycle easements
over, under, across and upon the entire above described
tract, and the right to enter thereupon for .the purposes
of ,construction reconstruction, repair and maintenance.

Section 1. The City Council of the City of Eugene herein ini-
tiates the vacation proceedings on its own authority without peti-
tion or consent of the property owners, except as provided by statute,
of the above described alley.
Section ~: A hearing shall be held upon the proposal to vacate
the alley as herein provided, and the hearing shall be held on the
9th day of September, ~,981~, at noon Pacific Daylight Time of said
date, at the Council Chambers at City Ha11, Eugene, Oregon, at which
time all persons will be heard upon objections or suggestions with
regard to the vacation, and at said time the Council will provide for
the va,cation~. of the ~a~.ley or deny such vacation, and in case the vaca-
tion is made, wi1.1 px.o~ride and make pro~rison for any damages sus-
tained by local assessment.
Section 3. TheCity Record~eri,s hereby. d~.rected to immediately
publish ante each week for four co~,se:cutiwe weeks in a newspaper pub-

lished in Eugene, bane County, Ure~~n, notice o~ the proposed vaca-
tion. The notice shall give a description of the area to be vacated
as herein set out; state the date when this ordinance was passed, the
name of any petitioners petitioning fo~c the vacation, and the date
when the petition., together with any objections or remonstrances which
may be made in writing and filed with the Recorder of the City of
Eugene prior to the date of th.e hearing,~will be heard and considered.
Section ~~~~. The City Recorder shall forthwith and within five
days after the fi.r~s~t publication of~ the notice post, or cause to be
posted, at or near each end of th_e proposed 'vacation a copy of the
foregoing., which shall, be heeded "Notice of A11ey Vacation," and which
notice shall be posted .gin at least two conspicuous places in or on the
area proposed to be ~va~cated.
The pasting and the first day of publication of the notice shall
be not less than twenty-eight ~2 $ ~ days before th.e time set for hear-
ing.

NOTICE IS HEREBY GIVEN that at a meeting of the City Council
of the City of Eugene, Oregon, held at the Council Chambers at City
Hall, Eugene, Oregon, on the 16th day of December, 1981, upon
motion duly made, seconded and passed, a hearing was set to be
held on the 2Gth day of January, 1982, at 12ry00 noon, Pacific Stand-
ard Time, at the Council Chambers at City Hall, Eugene, Oregon, far
the purpose of hearing remonstrances and protests against the vaca-
tion by Ordinance of the City Council of the previously tabled alley
vacation, to-wit:
