THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council does here~ay order a special elec- tian to be held in the City of Eugene, Oregon, concurrently with the Lane County special election on Tuesday, September 15, 1981, at which election there shall be submitted to the electors of the City for their approval ar rejection, the fallowing Measures, to-wit: MEASURE N0. 51 MEASURE SUBMITTED TO THE VOTERS BY THE CITY COUNCIL QUESTION: Sha11 City Council levy in excess of 1981-82 Charter tax limit general property taxes of $1x161,464 for 19 81- 82 tax year PURPOSE: As required by the City Charter, to provide voter authorisation for the City Council to levy an addi- tional general property tax in fiscal year 198182 within the City's tax base. Funds to be used for general opera-- tianal and capital projects expenditures. This levy is in addition to the levy proposed in Ballot Measure 52 and is to be partly financed by the State of Oregon. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: BE IT ENACTED BY THE ELECTORS OF THE CITY OF EUGENE, OREGON: Section 1. As provided by Amendment z of the Eugene Ordinance - 1 I88µ7 Charter of 197, the City Council is hereby authorized to levy in fiscal year 1981-82 a property tax within. the tax base approved by the ~roters on May 2U~, 1984 of $1,161,44 for general city operations and capital project expenditures during the tax year July 1, 1981 to June 34, 1982. Section 2. The property tax authorized in Section 1 above i~s in addition to any other property tax levy approved far fiscal year 1981-82 and will be financed partly by the State of Oregon. This measure authorizes a total property tax levy of~$17,~61,464 for the fiscal year 1981-82, and if Ballot Measure 52 is also passed, the total property tax levy for 1981-82 will be $18,313,?37. 1981. 5ectian 3. PURPOSE: As req~.'~~~.~~ed by City Charter, to provide voter authorization for the City Council to levy an additional general property tax in fiscal year 1.951-82 within the City's tax ~ base. Funds to be used to compensate E'W'EB for transfer of Gillespie Butte property from utility uses to park uses and for related expenses. This levy is in addition to levy proposed in Ballot Measure 51 and is to be partly financed by the State of Oregon. THE CITY OF EUGENE pOES ORDAIN AS FOLLOWS: BE IT ENACTED BY THE ELECTORS OF THE CITY OF EUGENE, OREGON: Section 1. As provided by subparagraph ~3~~d~ of Amend- ment T of the Eugene Charter of 1976, the City Council is hereby authorized to levy in fiscal year~July 1, 1981 ~- June 30, 1982, ~, property tax within the tax base approved by the voters on May 2 D , 1 ~? 8 4 , c;f $ 65 2 , 2 7 3 to compensate th~~ Fuger~e Water & Electric Board for the transfer of Gillespie Butte property from utility uses to park uses and to pay far other expenses related to the transfer and use ~of the property for park purpose. Section 2. The property tax levy authorized in Section Ordinance - 2 18847 1 above is in addition to any other property tax levy approv- ed far fiscal year 19 81-- 8 ~ ~ and wi 11 be financed partly by the State of Oregon. This Measure authorises a total property tax levy of $17,152, 2~'3 for the fiscal year 1981-82, and if Ballot Measure 51 is a~.so passed, the total property tax levy for 198182 will be $18,313,77. Section. 3» This Measure shall become effective July 1, 1981. Section 2. The proposed Measures shah be placed upon the offi-~ cial ballot by the City Recorder. There shall be furnished to the County Clerk for Zane County a certified copy of the ballot questions and purposes for the Measures and numbers of the Measures to be voted upon. The City attorney shall prepare and the City Recorder shall furnish the ballot tit],es for the Measures and direct that the County Clerk of Lane County place the Measures upon the regular ballot to be used at the Lane County special election to be held on September 15, 1981, to be voted upon by the electors of the City at the spe- vial City election. Section 3. The necessary poll books, ballot boxes, tally sheets, and such other supplies for each precinct as are necessary for the carrying on of said election shall be furnished by the County Clerk for Lane County, and the supplies shall be delivered to the Election Board. Section 4. The City Council hereby orders that the election shall be held as a special e~,ection for the City of Eugene concur- rently with the Lane County special election on Tuesday, Se tember p 15, 1981, and hereby designates as the polling places for the elec- tion in the City of Eugene the polling places established and desig-~ Hated for the Lane County special election, and the City Council does hereby appoint the Clerks appointed to serge at the Lane County Ordinance ~- 3 is8~+, special election to serve in each. of the polling places for the City election. Section 5. The polls shall be open in each of the voting pre- cincts at 8:00 0' clod a.,rn. , Pacific Daylight Time, and shall be kept open until 5:00 o'clock p.m., Pacific Daylight Time, on election day. Section G~. The C1e~k acting as ch.a~rman of the Election Board in the Lane County special election shall be chairman of the same board of which he ox she is a ~ member a.n the City election, and the ballots shall be counted and tabulated and the results certifa.ed as provided by law. Section 7. The City Recorder is hereby directed to give not less than ten days notice of the special election by publication of one notice thereof in the Eugene Register Guard, a newspaper publish-- ed in the City and of genexal circulation therein. Section 8. The amatters contained herein affect the peace, health, and safety of the citizens of the CZty of Eugene, and there- fore, an emergency i.s declared to ex~:st, a~,d this ordinance shall become effective immediately upon its. passage by the City Council and approval by the Mayox.
