HomeMy WebLinkAboutOrdinance No. 18848ORDINANCE N0. 18848 AN ORDINA~!~CF` CC)NCERNING POSSESS~4N OF LIQUOR BY PERSONS UNDER 21 YEARS OF AGE AND THE USE OR POS- SESSION OF LESS THAN ONE OUNCE OF MARIJUANA; AMENDING SECTZ4NS 4.115 AND 4.994 OF THE EUGENE CODE, 1971; ADDING ..A NEw SECTION 4.240 T4 THAT CODE; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Section 4.115 of the Eugene Code, 1971, is amended to read and provide: 4.115 Minors -Purchase or Possession of Liquor Prohibited; Exception. ~~l} Except as provided in section 4.12D of this code, no minor shall attempt to purchase, purchase, acquire, or have in his or her possession any alcoholic liquor. ~2} For the purposes of this section, possession of alcoholic liquor includes the acceptance or consumption of a bottle of such liquor, or any portion thereof, or a drink of such. liquor. The physical act of consuming the alcohol need not occur within the corporate limits of the city. Section 2. There is hereby added to the Eugene Code, 1971, a new section, to be numbered and provide.: 4.24 Use or Possession of Less than One Ounce of Mari'uana. ~~_1~ No person shall knowingly or intentionally use or possess less than one avoirdupois ounce of the dried leaves, stems and flowers of the plant marijuana unless used or posses- sed pursuant to a prescription valid within the state of Oregon. {2} For purposes of this section, marijuana includes the leaves, stems, flowers and seeds of the plant Cannabis family Moraceae, whether growing or not; but shall not include the resin or oil extracted from any part of such plant, and every compound, manufacture, salty derivative, mixture or pre- paration from such resin or oil, including hashish and natural or synthetic tetrahydrocannabinol; and shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other com- pound, manufacture, salt derivative, mixture or preparation of such mature stalks, fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination. Section 3. Section 4.99 of the Eugene Code, 1971, is hereby Ordinance -- 1 88'8 amended by adding a new subs~ecta~on tY~e~eto, to read and provide 4.99a Pen~~lt~es -~ 5pec:i~fc. ~12~ Proceedings forviolation of sect~,ons 4.115 and 4.240 shall be civil in nature, and a violation thereof is punishable by a fine not to exceed $100. Section 4. That the matters contained herein concern the pub- lic health, welfare and safety and therefore, an emergency is hereby declared to exist and this Ordinance shall become effective immedi- ately upon its passage by the City council and approval by the Mayor.
