QZ5,. 3.130, 3.135, 3.140, 3.145, 3.1,GQ, AND 3.165 of THE EUGENE CODE , l9 71; ADD I~G SECTfiONS~ 3.15 2 , 3.17 Q , 3.17 2 , 3.17 3 , AND 3.17 4 TO THAT CODE ; AND DE- CLARING AN EMERGENCY. THE CITY OF EUGENE DOES oRDATN AS FOLLOWS: Section 1. Section 3.QD5 of the Eugene Code, 1971, is hereby amended by amending the definition of Ambulance, and adding in alpha- betical order therein definitions fox First Aid vehicle and Invalid or ~~heel-Chair Coach, to provide as follows: 3.445 Definitions. For the purposes of this chapter, the following words and phrases shall mean: Ambulance. A privately owned motor vehicle for hire that is constructed, equipped, or regularly pro- vided or offered to be provided for the emergency transportation or transportation in the recumbent position of persons suffering from illness, injury, or disability. A privately owned orator ve- hicle for hire that is constructed, equipped, or regu- larly provided for the nonemergency transportation in the. sitting or non-recumbent position of persons suffering from illness, injury, or disability, and not requiring ambulance service. Section 3.025 of the Eugene Code, 1971, is hereby amended to read and provide: 3.425 Liabi~.ty Insurance Rec~uixed. ~:1} Applicants +~~fvr licenses for which public liability insurance is required according to Column F, section 3.010, shall submit certificates of insurance, with a 30-day notice of canceYlaton clause, to the finance officer prior to the issu- ance of the license. Except as provided in subsection ~2} of this section, public liability insurance shall include limits of coverage of not less than $100,000 per person for bodily in- ~ury, $3o0,00o per occur.~ence for bodi~,y injury, and $50,000 per occurrence for p~aperty damage, and shall be extended to cover completed operations. ~:2} Public liability insurance required for the opera-~ tors of ambulances, first aid vehicles, or invalid or wheel- chair coaches shall be a single limit coverage per occurrence of not less than $500, 000 fvr bodily injury and for property damage, and shall be extended to cover completed operations. Section ~4. section 3.130 of the. ~u~ene ~o~,e, 1971, is hereby amended to read and p~.ovde: 3.130 ~a~ula~~ce - Public Heari~~ ~ ~ on A lication. Upon the filing of ~n application for an a~nb~ulance operator's ordinance ~- 2 /$~53 license, the finance of f ice~x~ shall ~i~x a time and place for public hearing before the council. Tee days written notice of the hearing shall be given to the applicant by certified mail and to all persons who have current ambulance. operator's licenses. Ngtice shall be given to the general public b ost- Yp ing the time and place of the hearing in the city hall. inter- ested persons nay file a memorandum with the city manager in support of or in opposition to the issuance of a license, .At the hearing, if the council determines that the applicant is qualified, that an additional, licensed operator is necessar to meet the needs and r '~ ,y equireme~ts of the city, and that the a.ssu- ance o~ such a license would be in the best interest of the citizens of the. city, it shall order the finance officer to issue the license. If the council finds the applicant is unqualified, that the ad~.itional service is nvt needed, or would not be in the best ,interest of the citizens o~ the city, it shall order the finance off ices to deny the Zicense. The decision of the council shall be final. Section 5. Subsection ~_d~ of Section .3.1,35 of the Eugene Code, 19?1, is hereby amended to read and p~o~ide: 3 . l3 5 Ambulance -~ Dri~ex and Attendant Re uirements . The finance officer shill issue a license to an ambulance drier, attendant or dri~uer-attendant only upon receipt of proof that the applicant: ., ~:d ._. zs certified by the state of Oregon pursuant to CRS 485.500 through 485.595 and DRS 677.~1Q through 67?.740 yr their successor statutes as an emergency medical technician I, I~T, TIT, or Iv. Section 6. Section 3.140 of the Eugene Code, 19?l, is hereby amended to read and pro~ride: 3.14 0 ~rib~ul~a~n~ce D~r%~~rer ~to ~be ~cc~o~panied, ~1~ T~h~ri an ambulance ~is operating as a basic life support unit transporting a patient, at least one licensed attendant, state certified at or abo~re an emergency medical technician I training level, shall accompany the driver. ~2~ 'then an ambulance is operating as an advanced life support unit transp~rtin~ a patient, at least two licensed atten- dants, one state certified at or abo~re an emergency medical tech- nician III: training level aid one state certified at or above an emergency medical, technician ~ traini~.g level,, shall be in the ambulance.. The~emezgency medical technician ~ may, if ro erl p p Y licensed, dx~i~ve the ambulance. Ordinance - 3 18853 Section 7. Section 3.1.45 of th.e. Eugene Code 1971, is hereby amended to read and provide: 3.145 Amb~ul,ance Operator - Gro~u~nds for Sus erasion or Revoca-- ~tiwn. 2n addition to other grounds specified in this code, an ambulance operator's ~.icense can be suspended: ~a~.. If the license holder abandons the operation of its ambulance service for one or more days except or reaso~,s beyond a.ts control. ~.b~_ If the license holder fails to render satis- factory service. Section 8. There is hereby added to the Eugene Cade, 1971, a new section to be numbered and provide: 3.15 Awail~abi~lit ~ of Ambul~;nce Records. An ambulance opera- tor shall ~nanta,in adequate records of transportation of all patients and shall maintain financial records in accord- ance with acceptable accounting practice. All books and records of an ambulance operator shall be available for inspection by the city at any reasonable timeupon ~4 hours notice in writing. Section 9. Section 3.16a of the Eugene Cade, 1971, is hereby amended to read ar~d pro~r.de 3.164 F~ui~a,g~at,io,a~„sand Di,,,s,,,rif:ection. Section ~10. Section. 3.x.65 of the Eu~e~e Code, 1971, is hereby amended to read and provide 3.165 ~Res~ons~:bil;it~r,,,,of ~~e;rator. An ambulance, first aid vehicle, or invalid or wheel-chair coach operator shall supervise his ar her employes inspect his ar her equipment to assure that at all times it meets the requirements of this code, and maintain a record of all equipment inspections that shall be available for review by the city upon ~4 hour notice in writing. The operator shall not permit a person who is under the influence of intoxicatin.~ liquor or drub to drive an ambulance, first aid vehicle, or ~inva.lid or wheel.-chair coach, or tv accompany the same as an atte~da~,t. Tn the e~'ent an employe violates a pro- vision o~ th.;s chapter, the operator may be held responsible and his or h.e:r l~cens~e nay be revoked for the violations . Ordinance - 4 1853 Section ll. Upon ~nak.ng application for a first aid vehicle operator's li.ce~;s~e~, the applicant shall. submit a list of supplies and equipment to be carried ire each vehicle. This list shall be~sub~ect to review and approved annually at the Ordinance -- 5 18853 time of the license holder's renewal, and shall be filed with. the finance officer. ~.3 ~. The: operator o~ a ffirst aid vehicle shall maintain a record o~ each time a person i~s transported, including date, time of day, origin and destination, name of person, nature of injury, illness, or disability, and assistance rendered. Each invalid or wheel-chaix coach shall be equipped with adequate tie down facilities, to maintain the wheel chairs transported therein in a stationery position. ~=3~. The in~`alid or wheel-chair coach shall not carry e~riergency warning lights or siren. section ~.2. That the provisions contained herein concern the public health, welfare ~.nd safety a,nd th.ere~ore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the ~Sayor .
