AN ORDINANCE CONCERNTNG ToC~ CARS; REGULATING THE
SIGNING pF PRIvATE AND RU$LIC PARKING FACILITIES;
AMENDING SECTIpNS 3,D05 AND 5.990 OF THE EUGENE
CODE, 1971, ADDING SECTTpNS 3.460 AND 5.540 TO
THAT CODE; PRpVIDIN`G FOR AN EFFECTIVE DATE; AND
DECLARING AN EMERGENCY:
The City Council of the City of Eugene finds that:
Many parking facilities within the City are inadequately si ned

is improperly used.
Property owners ar~d operators of vehicle towing businesses
have a responsibility to give motor vehicle owners reasonable notice
that a motor vehicle may be towed away at its owner's. expense if it
is improperly parked.
It is in the public a.nterest that the City establish regulations
that preserve the rights of property owners to regulate parkin on

their premises and requiring that adequate notice thereof be rovided

to the public. Now, therefore,
THE CITY OF EUGENE DOES pRDAIN AS FOLLOWS:
Section 1, Section 3.0.05 of the Eugene Code, 1971, is hereb

amended by inserting in alphabetical, order therein the fallowin :

Definitions. For purposes. of this chapter, the follow-
ing words and phases shah, mean:
Tow car. Amotor vehicle which has been altered
or desa:gned and equipped for the use and the business
of towing vehicles by mews of a crane, hoist, towbar
towline, or dolly, or is otherwise used to render
assistance to other vehicles.

Section 2. There is hereby added to the Eugene Code, 1971, a
new section, to be numbered and provide:
3.460 Tow Cars -- Dish of Rates.
~l~ Persons engaged ~~~n~the business of operating taw
Cars for hire shall display inside their place of business a
sign containing the schedule of rates for all tow car services
and vehicle storage. The letters and numerals on the sign
shall be machine or~block lettered and readable from the areas
of the business open to the public.
~-2} Tow cars when used to remove motor vehicles from
parking facilities as defined by section 5.540 of this code
shall have displayed on the tow car in a manner Basil read

from outside the tow car, the schedule of rates for impounding
and disconnecting a motor vehicle. The sign shall also declare
no fee shall be charged if the operator of the motor ve~.icle
returns to the motor vehicle before it is connected to the tow
car. The letters and numerals on the sign shall be~machine or
block lettered and readable fxom a~ distance of 20 feet.
Section 3. There is hereby added to the Eugene Code, 1971, a
new section to be numbered and provide:

~~1~ ~s used in this section "parking facility" means
any real property or any building or portion thereof, private-
ly or publicly owned, which has been marked with designated
parking spaces for motorvehicles, or any~real property which
has not been marked with designated parking spaces for motor
vehicles which by function, custom or usage would cause a rea-
sonable person to believe it is used for parking motor vehicles.
~~2 ~ Except for a police officer performing official
duties, it shall be unlawful for any person to remove or direct
the removal o~ a motor vehicle. from a parking .facility without
th.e motor ve~hZCle owner's per~nissvn unless the parking facility
has permanently erected or affixed signs as required by subsec-
tion ~ 3 ~ of this section.
~-~3 } Parking facilities shall have :
~a~ At each. entrance thereto, in plain view to
any person ente.rn~ the. facility in a motor vehicle,
a sign which:

less than 3 square feet in size;

subsection which are readable from each parking space;
or
~:c~ At each. designated parking space an indivi~-
dual sign of not less°than one square foot nor more
than three square feet in size containing the notice
prescribed in paragraph ~a~2, of this subsection.
Section 4. Subsection ~.2~ of Section 5.990 of the Eugene Code,
1971, is hereby amended to read and provide:
5.990 Penalties - Specific.
~2} Violation of Sections 5.060 to 5.155, 5.540, 5.550
and 5.555, and 5.620 to 5.625, is punishable by fine not to ex-
ceed $100.
Section 5. That the provisions contained herein concern the
public welfare and safety and then.efare, an emergency is hereby de-
clared to exist, and this Ordinance shall become effective l5 days
after approval by the Mayor, except Section 3 shall not become effec-
tive until November 15, 1981.
