AN ORDINANCE CflNCERN`ING THE DOWN~`a'wN DEVELOPMENT
DISTRICT; ~MENDTNG SECTIDN 2.3$0 QF 'THE EUGENE
CODE, 1971; DECLARING AN EMERGENCY; .AND PROVIDING
AN EFFECTIVE DATE.
The City Council of the City of Eugene finds .that.
Tn 19?2, the Downtown Development District was created for the
purpose of financing and administering programs of economic promo-
tion and development, public parking, and promotion of all modes of
transportation within the central business district.
At the time of the creation of the Downtown Development Dis-
trict, the property within the District north of 7th Avenue was to
be cleared, placed in parking, and offered far future development.
Since the creation of the Downtown Development District, the
property north of 7th Avenue has been developed with the Eugene
Performing Arts Center, the Eugene Conference Center, a hotel, and
over 800 off-street parking spaces.
The Eugene Performing Arts Center, the Eugene Conference Center,
the hotel and parking spaces lay partially within and without the
Downtown Development District, necessitating adjustment to the Down-
town Development District boundaries by expanding or contracting
the boundaries.
The Performing Arts Center, Conference Center, hotel and park-
ing facilities represent unique, integrated facilities within the
community, a significant portion of which are in public ownership
and control.
The Eugene Performing Arts Center, the Eugene Conference
Center, the hotel and parking facilities are integrated physically
and their operation and function make it difficult to separate the
public and private facilities for taxing purposes.
The public facilities owned by the City are not subject to
the Downtown Development District taxes and less than one half of
the hotel is within the existing boundaries of the District and
will be physically separated from the rest of the property within
the District by the public conference facilities and a state high-
way with high traffic volume.
The removal of these facilities from the Downtown Development
District will not adversely affect the purposes for which the Dis-
trict was created.

THE CITY QF EDGENE DOES ORDAIN AS FQLLOWS:
Section 1. Based upon the above findings, which are incor-
posted herein, Section 2.380 of the Eugene Code, 1971, is hereby
amended to read and provide:

7th Avenue and 8th Avenue; thence east to the center of block
7, Skinners Addition; thence north 60 feet; thence east to the
center line of Olive Street; thence north to the center line
of 7th Avenue; thence east to the center of the north-south
alley between~Willamette Street and Oak Street; thence south
to the cente~~line of South Park Street; thence east to the
center line of East Park Street; thence north to the center
line of 8th Avenue; thence east to the center line of Pearl
Street; thence south to the center line of 11th Avenue, thence
west to the center of the Werth-south alley between Pearl
Street and Oak Street; thence south to the north line of lot
6, black 2, Christian's Addition; thence west to the center
line of Oak Street; thence north to the south line of lot 4
cif extended east, block~20, MulliganTs Donation; thence
west to the center of the north south alley between Oak Street
and Pearl Street; thence south .120 feet; thence west to the
center line of Willamette Street; thence north to the north
line of lot 1 ~.if extended east , block A, Dorris Addition;
thence west to the center of the north--south alley between
Willamette Street and Olive Street; thence south to the
center of the east-west alley between 11th Avenue and 12th
Avenue; thence west to the center line of Olive Street;
thence north to the center line of 11th Avenue; thence west
to the center line of Charnelton Street; thence north to
the center line of 10th Avenue; and thence west to the paint
of beginning, is hereby designated the Downtown Development
District.
Section 2. That the matters contained herein concern the
public welfare, and in order to insure the orderly implementation
of the Downtown Development District taxes, an emergency is hereby

declared to exist, and this ordinance shall become effective immedi-
ately upon its adoption by the Council and approval by the Mayor,
retroactively to July 1, 1981.
