An ordinance vacating the following described street, and
declaring an emergency, to-wit:
As described on Exhibit "A" attached hereto and
incorporated herein by reference . ~.Ci ty of

The City Council of the City of Eugene finds that:
1. On the 29th day of April, 1981, the City Council of the
City of Eugene passed ordinance No. 18780 setting a hearing to be
held on the Sth day of June, 1951, at the Council Chambers at City
Hall, Eugene, Oregon, at which time and place protests and remon-
strances could be heard as to the proposed vacation of the above
described street.
2. Notice was duly and regularly given of the hearing and
a hearing was held pursuant to the ordinance at the Council
Chambers, at City Hall, Eugene, Oregon, on the 8th day of June,
1981, at 7:30 p.m., Pacific Daylight Time, and at said time and
place the Council heard all objections.
3. Remonstrances were filed by several of the owners of
affected real property as defined in oRS 271.080, However, the
objecting owners fail to comprise ownership of the majority of
the area affected under oRS 27,.130. Because of this, and be-
cause the owners of abutting property to the vacated area have
consented to the vacation and applied for the same, and in light
of these findings, such remonstrances are denied.
4. In order to evaluate the merits of such remonstrances,
the City staff at the June S, 1981 Council meting was directed
to return to the Council at a future date with a recommended
course of action.
5. on July Sr 1981, the City Council again considered the
matter and directed the formation of a special task team to re-
turn with a recommended course of action.
6. On December 7, 1981, the Council reviewed the recommen-
dation of this special task team and after consideration of that
report and additional public testimony on the task team report,
determined that the vacation of the street as described in Exhibit
"A" hereto is in the public's interest and that the public inter-
est will not be prejudiced by this street vacation.

Now, therefore, based on the above findings,
TI3E CITY OF EUGENE DOES ORDAIN AS FQLLOWS:
Section. 1. The City Council of the City of Eugene finds that
due and regular notice of the hearing was published and posted as
by law required and no valid objections have been made at the hear-
ing or filed. The consent of the owners of the abutting property
has been duly and regularly filed in the proceedings and the public
interest will not be prejudiced by the vacation of the street.
Section 2. The hearing was concluded on the Sth day of June,
1981, and on December ?, 1981, at 7:30 p.m., Pacific Standard Time,
at the Council Chambers, City Hall, Eugene, Lane County, Oregon,
the Council considered the task team's report, and all matters
necessary to be done in the premises have been duly and regularly
completed.
Section 3. The hereinabove described street is hereby vacated,
and the street so vacated shall revert pursuant to the statutes. of
the State of Oregon.
Section 4. The City Recorder is hereby directed to file a
certified copy of this Ordinance with the Recorder of Lane County,
Oregon, together with a map or plat of said property, and a certi-
fied copy of this Ordinance shall be filed with the Lane County
Assessor and another certified copy shall be filed with the Lane
County Surveyor.
Section 5. The street vacation described herein is necess i-
tated by reason of construction in connection with the Performing
Arts Center and Convention Center. It is in the public interest
that the vacation be immediate~.y effective in order to meet dead-
lines in that construction activity and therefore, an emergency
is hereby declared to e~ist~ and this Ordinance shall become
effective immediately upon its passage by the City Council and
approval by the Mayor.
