HomeMy WebLinkAboutOrdinance No. 18909ORDINANCE NO. ~g9Oq An Ordinance vacating the following described alley, to-wit: Beginning at the Northeast corner of Lot 1 of Over- look Addition, as platted and recorded in Volume 4, page 9, Lane County oregon Plat Records, run thence North along the West line of Augusta Street, 12 feet, thence West parallel with the North. line of Overlook, 130 feet, thence South 12 feet to the North line of overlook, thence East 130 feet along the North line of Lot 1~ overlook, to the point of beginning in Eugene, Zane County, oregon. RESERVING herein public utility and bicycle easements over, under, across and upon the entire above described tract, and the right to enter thereupon for the purposes of construction, reconstruction, repair and maintenance. Lindsey - AV 75-2~ 4n the 22nd day of Judy, 1981,. the City Council of the City of Eugene passed ordinance No. 18332 setting a hearing to be held on the 9th day of September, 19$1, at the Council Chambers at City Hall, Eugene, oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation of the above described alley. Notice was duly and regularly given of the hearing, and at said time and place the hearing was indefinitely postponed. Un December 1G, 1981, upon motion duly made, seconded and passed, a hearing was set to be held on the 20th day of January, 1982, at 12:44 noon, Pacific Standard Time, at the Council Chambers, City Hall, Eugene, oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation of the above described alley. Notice was duly and regularly given of the hearing, and a hearing was held pursuant to such notice at the Council Chambers., at City Hall, Eugene, oregon, on the 20th day of January, 1982, at Noon, Ordinance - l 1890q Pacific Standard Time, and at said time and place the Council heard all objections. All persons owning property abutting upon the alley to be va- sated have consented to the vacation and applied for the same. THE CITY of EUCE~'E DOES ORnAI~V AS FOLLOWS: Section 1. The City Council, of the City of Eugene finds that due and regular notice of the hearing was published and posted as by law required and no valid objections have been made at the hear- ing ar filed. The consent of the owners of the abutting property has been duly and regularly filed in the proceeding, and the public interest will not be prejudiced by the vacation of the alley. Section 2. The hearing was held on the 20th day of January, 1982, at noon, Pacific Standard Time, at the Council Chambers, City Hall, Eugene, Lane County, Oregon, and all matters necessary to be Bane in the premises have been duly and regularly completed. Section 3. The hereinabove described alley is hereby vacated, and the alley so vacated shad revert pursuant to the statutes of the State of Oregon. Section 4.. The City Recorder is hereby directed to file a cer- tified copy of this ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certi-~ fled copy of this Ordinance shall be filed with the Lane County Assessor and another certified copy shall be filed with the Lane County Surveyor.
