AN ORDINANCE CONCERNING ZONING REGULATIONS;
AMENDING SECTIONS 9.450, 9.452, 9.464, 9.466,
9.4 7 D , 9.4 7 4 , AND 9.7 4 2 Off' THE EUGENE CODE ,
1971; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FQLLOwS:
Section 1. Section 9.454 of the Eugene Code, 1971, is hereby
amended by deleting subparagraph ~i~, amending subparagraphs ~j~ and
(k), relettering subparagraphs (j),(k)~.(~;~~(~j~~(~~;~o) and (p} to (1}:,(j),(k),
(1),(m),(n),and (o) respectively, and adding after subparagraph
~o~ an unnumbered, unlettered paragraph to read and provide:
9.454
~~} Parking areas; private.
~j} Parking garages; private.
Buildings and uses existing as of January 27, 1982 are
exempt from sections 9.612 to 9.626 pertaining to nonconform-
ing uses.
Section 2. Section 9.452 of the Eugene Code, 1971, is hereby
amended to read and provide:
9.452 Buildin s and Uses Permitted Canditionall .
~1~ In addition to the buildings and uses permitted
conditionally listed in sections 9.492 to 9.542, the hearings
official may grant a conditional use permit for any of the
following buildings and uses in accordance with the procedures
set forth in sections 9.696 to 9.722:
~a} Manufacturing, compounding, bottling, pro-
cessing, packaging, or treatment of food and beverage
products.
fib} Other uses similar to the uses permitted or
permitted conditionally.
~2} Upon finding that the fallowing proposed use is
dependent on or at least provides a direct service to people
engaged in industrial uses, the hearings official may grant a
conditional use permit for any of the following Buildin s and

uses in accordance with the procedures set forth in sections
9.696 to 9.722:
~a} Offices for engineers, architects, landscape
architects, surveyors, and those engaged in the prac-
tice of designing, drafting or graphics.

Section 3. Section 9.464 of the Eugene Code, 1971, is hereb

amended to read and provide:
9.464 Permitted Buildings and Uses. In the M-2 Light Indus-
trial District, the following buildings and uses are
permitted as hereinafter specifically provided, subject to the
general .provisions and exceptions set forth in this ordinance
beginning with and following section 9.532.
If, however, any permitted building or use would be hazard-
ous, obnoxious, offensive or unsightly by reason of emission of
odor, sound, vibration, radioactivity, electrical interference,
glare, liquid or solid wastes, smoke or other air pollutants,
said building or use shah be treated as a conditional use,
subject to the issuance of a conditional use permit, in accord-
ance with the procedures set forth in sections 9.696 to 9.722:
~a} Accessory buildings and uses normal and
incidental to the buildings and uses permitted in
sections 9.462 to 9.466.
fib} Agricultural machinery, sales and services.
~c} Agricultural supplies, including hatcheries.
~d} Agricultural uses or any other enterprise
customarily carried on in the field of general agricul-
ture. Except no slaughterhouses permitted.}
fie} Automobile painting shops.
~f} Bakeries, wholesale and retail.
fig} Building material sales.
~.h} Christmas tree sales outdoor sales}
from the day after Thanksgiving to January 1.
~1} Dwellings, single family, or dwelling
unit, limited to one, far a caretaker or superintendent,
whenever the use requires the on-site residence of such
person.

Section 4. Section 9.466 of the Bugene Code, 1971, is hereby
amended to read and provide:
9.466 Buildin s and Uses Permitted Conditionally.
~l~In addition to the buildings and uses permitted
conditionally, listed in sections 9.492 to 9.502, the hearings
official may grant a conditional use permit for any of the
following buildings and uses in accordance with the procedures
set forth in sections 9.696 to 9.722:
~a} Asphalt botching.
~b~ Concrete mixing concrete batch plant.
~c~ Manufacturing, compounding, bottling,
processing, packaging, ar treatment of food and bev-
erage products except fish, meat, sauerkraut, vine-
gar, yeast and alcoholic beverages.

~d} Natural mineral resources, development of,
together with the necessary buildings, apparatus, or
appurtenances thereto, including but not limited to
rock, sand, gravel and mineral dredging, processing
and stockpiling, top soil, removal, and all types of
mineral recovery or mining, excluding smelters and
ore reduction.
~2} Upon finding that the following proposed use is
dependent on or at least provides a direct service to people
engaged in industrial uses, the hearings official may grant a
conditional use permit for any of the following buildings and
uses in accordance with the procedures set forth in sections
9.696 to 9.722:
~a } Banks .
~c} Barber shops.
~a} Beauty shops,
fie} Building maintenance.
~f} Convenience grocery stores with a
maximum of 2, 640 square feet.
fig} Parking areas, public.
~h} Parking garages, public.
1 Restaurants.
~_j} Service stations.
Buildings and uses existing as of ~'anuary 27, 1952 are exempt
from sections 9.612 to 9.626 pertaining to non-conforming uses.
Section 5. Section 9,474 of the Bugene Code, 1971, is hereby
amended to read and provide;
9.47p Permitted Buildings and Uses. In the M-3 Heavy Indus-
trial District, the following buildings and uses are
permitted as hereinafter generally outlined in this section,
provided that no building or use specifically listed in sec-
tions 9.472, 9.474, and 9.492 to 9.5Q2 shall be permitted un-
conditionally,
If any permitted building or use would be hazardous, ob-
noxious, offensive or unsightly by reason of emission of odor,
sound, vibration, radioactivity, electrical interference,
glare, liquid or solid wastes, smoke or other air pollutants,
said buildings or use shall be treated as a conditional use,
subject to the issuance of a conditional use permit, in accord-
ance with the procedures set forth in sections 9.696 to 9.722.
Buildings and uses permitted in sections 9.468 to 9.474
shall be subject to the general provisions and exceptions set
forth in this ordinance, beginning with and following section
9.532.
~a} Industrial buildings and uses. All manu-
facturing, warehousing, wholesaling, compounding,
assembling, processing, storing, researching, treat-
ing or testing or any combination thereof of items,
materials or goods, is permitted.

In addition, all industrial uses not listed
elsewhere in this ordinance, and those uses listed
in section 9.464, are permitted. Those uses
listed in section 9.466 shall also be permitted as
conditional uses in this district.
~b~ Commercial buildings and uses. The follow-
ing buildings and uses devoted primarily to retail
sales and service, in addition to those listed in
section 9.464, shall be permitted:
1, other retail sales and services pro-
vided that they shall only be incidental and
directly related to the operation of industrial
uses.
~c~ Residential buildings and uses.:
1, ~7wellings, single family, or dwelling
units, limited to one whenever the use requires
the on-site residence of such person,
~d~ other buildings and uses:
1, Accessory buildings and uses normal and
incidental to the buildings and uses permitted
in sections 9.468 to 9,474,
2. Administrative and sales offices,
limited to those related to permitted industrial
uses,
3, Private parking areas and garages,
4, Public and semi-public buildings.
Buildings and uses existing as of are exempt from sections
9.612 to 9,626 pertaining to non-confor~~ing uses,
Section 6. Section 9.474 of the Eugene Code, 1971, is hereby
amended to read and provide:
9.474 Buildin s and Uses Permitted Conditionall .
~1} In addition to the buildings and uses permitted
conditionally, listed in sections 9.492 to 9,502, the hearings
official may grant a conditional use permit for any of the
following buildings and uses in accordance with the procedures
set forth in sections 9.696 to 9,722.:
~a} Abattoirs, provided that they are enclosed
within a building including storage of live or dead
animals.
~.b~ Billboards.
~c~ Incineration or reduction of garbage, dead
animals, offal or refuse.
~d} Automobile and building wrecking yards.
~2} Upon finding that the following proposed use is
dependent on or at least provides a direct service to people
engaged in industrial uses, the hearings official nay grant a
conditional use permit for any of the following buildings and
uses in accordance with the procedures set forth in sections
9.696 to 9.722:

Section 7. Section 9.702 of the Eugene Code, 1971, is hereby
amended by adding a new subparagraph ~.d} thereto, to read and pro-
vide:
9.702
~.d} In an M-l, M-2, or M-3 District, that the
proposed commercial use is dependent on or at least
provides a direct service to people engaged in indus-
trial uses.
Section 8. That the matters contained herein concern the
public welfare and safety, and in order to provide for the orderly
administration of the City's zoning ordinances, an emergency is
hereby declared to exist, and this Ordinance shall become effec-
tive immediately upon its passage by the City Council and approval
by the Mayor.
