LEVYING ASSESSMENTS IN CONNECTION WITh STORM
SEWER CONTSTRUCTIOI~ 1650 FEET FORTH OF ROYAL
AVENUE FROM TERRY STREET TO 900 FEET EAST;
AND DECLARING AN EMERGENCY ,
The City Council of the City of Eugene finds that:
On July l3, 1981 there was passed by the Council and. approved
by the Mayor, ordinance Teo. 18829 levying an assessment for a storm
sewer 1650 feet north of Royal Avenue from. Terry Street to 900 feet
east, against Daneland Mobile Houle Park, account number 500055-0010
in the total amount of $89,208.81.
A portion of .that assessment was challenged by the property
owner, and in accordance with a decision rendered in Lane County
Circuit Court Case No. 16-81-08245 on December 14, 1981, the assess-
ment has been recalculated, as more particularly set forth hereafter,
The property owner has reviewed and concurred with the new com-
potations, and has waived all rights to further notice, hearing or
right of remonstrance in connection therewith, and has requested
that the assessment be levied.
No other property or property owners are affected by this
assessment.
Now, therefore, Ordinance No, 18529 passed by the Council and
approved by the Mayor on July 13, 1981, should be amended as here-
inafter set forth.
THE CITY OF EUGENE DOES ORDAIN AS FQLLOti+~s:
Section 1. Based upon the above findings, which are incorpor-
aced herein, the following computations reflected on page one of
Ordinance - 1

Ordinance Na. 18829 are hereby amended:
~a} Item 7 is changed from $63,512.40 to $84,988.20;
fib} Item 9 is changed from $68, 232.93 to $47, 057. l3;
~c} Item 10 is changed from $63,812.40 to $84,988.20;
~d} In item 16 , the 10 a City charge far engineering
is changed from $6,823.29 to $4,705.71; the So City charge
is changed from $5,458.64 to $3,764.57; and item a, thereof
is changed from $12,281.93 to $8,470.28;
fie} Item 19 is changed from $6,381.24 to $8,498.82;
~f} Item 23 is changed from $159,402.45 to $157,708.38;
and
~.g} Item 24, the City's share of the cost is changed
from $70,193.64 to $93,487.02,
Section___2. The total cost of the construction as set forth in
Section 1 of Ordinance No. 18829 is hereby amended from $159,402.45
to $157, 708.38.
Section 3. The final assessment roll as contained in Ordinance
No. 18829 is hereby amended to provide as follows:

Section 4. Except as herein specifically amended, all other
provisions of Ordinance No. 18529 remain in full force and effect.
Section 5. That the matters contained herein concern the
public welfare, and in order to promptly record the lien hereof,

an emergency is hereby declared to exist, and this Ordinance shall
become effective immediately upon its passage by the City Council
and approval by the Mayor.
