HomeMy WebLinkAboutOrdinance No. 18942ORDINANCE NO. _~~ AN ORDINANCE ORDERING ALN ELECTION To BE CON- DUCTED BY THE LANE COUNTY ELECTION DEPARTMENT ON THE 18TH DAY OF MAY, 1982, FOR THE PURPOSE OF SUBMITTING TO THE LEGAL ELECTORS OF THE CITY 4F EUGENE A MEASURE AUTHORIZING $186,667 TAB ON OWNERSHIP OF REAL PROPERTY IN DOWNTOWN DEVELOPMENT DISTRICT; ADAPTING POLLING PLACES AND PROVIDING FOR ALL ACTS NECESSARY FOR THE CARRYING ON OF SAID ELECTION; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council does hereby order an election to be held in the City of Eugene, Oregon, concurrently with the primary election on Tuesday, May 18, 1982, at which election there shall be submitted to the electors of the City for their approval or rejec- tion, the following Measure, to-wit: MEASURE SUBMITTED TO THE VOTERS BY THE CITY COUNCIL MEASURE NO. 5l Shall City of Eugene tax owners of property in Down- town Development District $186,667 for 1982-83 free-parking program? THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: BE IT ENACTED BY THE ELECTORS OF THE CITY OF EUGENE, OREGON: Section 1. Measure authorizes tax of $186,667 outside Constitutional 6 percent limitation on ownership of real property in Downtown Development District only and not else- where in City for operating expenses of District July 1, 1982 to June 30, 1983. If Measure is approved, operating budget of District to be financed by taxation on ownership of real property in District for Tax Year 1982--83 will be $1,999 less than the operating budget so financed in~pre- ceding year. Section 2. If voters approve this Measure, the Down- town Development Board will be able to continue to provide FREE parking for patrons of the Downtown area, The cost Ordinance -~ 1 18952. for providing this service is paid partly by taxation on property owners within the Downtown Development District boundaries and is not supported by taxes outside these boundaries. If this Measure is approved, all of the tax will be financed by District taxpayers without any partial payment by the State. Section 3. This Measure shall become effective July 1, 19 82 . Section 2. The proposed Measure shall be placed upon the offi- cial ballot by the City Recorder. There shall be furnished to the County Clerk for Lane County a certified copy of the ballot title for the Measure and number of the Measure to be voted upon. The City Attorney shall prepare and the City Recorder shall furnish the ballot title for the Measure and direct that the County Clerk for Lane County place the Measure upon the regular ballot to be used at the primary election to be held on May 18, 1982, to be voted upon by the electors of the City. Section 3. The necessary poll books, ballot boxes, tally sheets and such other supplies for each precinct as are necessary for the carrying on of the election shall be furnished by the County Clerk for Lane County, and the supplies shall be delivered to the Election Board. Section 4. The City Council hereby orders that the election shall be held concurrently with the primary election on May 18, 1982 and hereby designates as the polling places for the election in the City of Eugene the polling places established and designated for the primary election, and the City Council does hereby appoint the Clerks appo~,nted to sere at the primary election to serve in each of the polling places for the City election. Section 5. The polls shall be open in each of the voting pre- grdinance - 2 1892 cincts at 8:00 o'clock a.m,, Pacific Daylight Time, and shall be kept open until 8:00 p.m., Pacific Daylight Time, on election day. Section 6. The Clerk acting as chairman of the Election Board in the primary election shall be chairman of the same Board of which he or she is a member in the City election, and the ballots shall be counted and tabulated and the results certified as provided by law. Section 7. The City Recorder is directed to give not less than ten days notice of the election by publication of one notice thereof in the Eugene Register Guard, a newspaper published in the City and of general circulation therein. Section 8, The matters contained herein affect the peace, healthy and safety of the citizens of the City of Eugene, and there- fore an emergency is hereby declared to exist, and this ordinance shall become effectively immediately upon its passage by the City Council and approval by the Mayor.
