It was the intent and understanding of the Board that Eugene Park Rules would be applied to Alton Baker Park as though it were a City park. That is, we understood that Park Rules would apply where applicable rather than general City Ordinance provisions. I am enclosing a copy of the Board Order, enabling those rules for your review. COUNTY, OREGO~ ) IN THE MATTER OF ENFORCEMENT OF ) CITY OF EUGENE PARKS & RECREATION ) DEPARTMENT RULES IN THAT PORTION ) OF ALTON BAKER PARK THAT LIES ) WITHIN THE CITY LIMITS OF EUGENE, ) OREGON -,' WHEREAS, a significant portion of Alton Baker park has been annexed to the City of Eugene, WHEREAS, the City of Eugene' therefore "can enforce'ordinances established by .Municipal Coqe within this portion of Alton Baker Park, WHEREAS, the City of Eugene Parks & Recreation Department utilizes departmental rules to further define and govern use of City of Eugene Parks, WHEREAS, these rules are not part of the Municipal Code, and therefore may only be enforced on lands managed by the Parks & Recreation Department unless permis'sion is granted by the land owner, WHEREAS, the County desires uniformity of rules for those parks, within the corporate limits of the City of Eugene, WHEREAS, the Coun~y has no adopted park rules, THEREFORE, the matter having been fully' considered by the Lane County Board of Commissioners, it is hereby ORDERED that the applicable City of Eugene Parks & Recreation Departmental Rules may be enforced within that portion of Alton Baker Park that lies within the corporate limits of the City of Eugene. ' IN THE MATTER OF ENFORCill1ENT OF CITY OF EUGENE PARKS & RECREATION DEPARTMENT RULES IN THAT PORTION OF ALTON BAKER PARK THAT LIES WITHIN THE CITY LIHITS OF. EUGENE, OREGON JOINT PARKS COMMITTEE ORGANIZATION AND BYLAWS The role of the Joint Parks Committee is to advise and assist staff the , Council, the Planning Commission, and other interested agencies regarding the City's park and recreation facilities, policies and programs. ARTICLE 1. SPECIFIC FUNCTIONS 1. As part of the Parks and Recreation Master Plan and leisure opportunities' planning process: a. Assist staff in analyzing existing and projected demand for parks and recreation facilities throughout the community; b. Advise on policies, guidelines, and programs to meet demand; c. Advise on priorities for specific facilities based on pollcies, guide- lines, and fiscal capability; d. Assist the staff in preparing a financial program to implement the Master Plan; e. Monitor the Master Plan to ensure it remains relevant; and f. Advise on Master Plan updates and amendments, and specific actions to meet changing circumstances. 2. Receive and, as necessary, respond to public suggestions and concerns within the context of adopted policies and plans as they relate to parks and recreation opportunities in the community. 3. Advise staff and, as necessary, propose specific actions to the City Coun- cil on matters as requested by staff or initiated by individual committee members. 4. Respond to planning commission and council requests for advice and propo- sals related to the community's parks and recreation facilities and programs. ARTICLE 2. MEMBERSHIP AND VOTING Section 1. The Joint Parks Committee shall consist of six members: Two councilors, nominated by Mayor, appointed by council, indefinite terms; two planning com~issioners, appointed by Planning Commission, indefinite terms; two citizens, 'nominated by Mayor, appointed by council, four year terms. Section 2. Each member of the committee shall be entitled to one vote at all regular and special meetings of the committee. If a member wishes to abstain in a situation where there is no direct pecuniary conflict of interest but where the public might construe that such a conflict exists) or if a member has a conflict deriving from his/her relatonship with the person involved, then he/she may ask the com- mittee whether he/she may abstain. If the committee says IIno," he/she must vote. This provision is intended to relate to close relatives and to pro- fessional relationships, as well as to friendships. Section 4. Any time a member present at a meeting does not record his or her vote, it is automatically recorded as a vote with the majority; an ab- stention must be entered as such in the minutes, with the reasons recorded. ARTICLE 3. COMMITTEE MEETINGS Section 1. Regular committee meetings shall be held at times and places agreed to by a majority of committee members. Special meetings may be called by the chairperson and held at times specified in advance in accordance with open meeting law and city code requirements. Section 2. Four members of the committee shall constitute a'quoram at a com- mittee meeting. If a quorum is present, the affirmative vote of the majority of the members present at the meeting and entitled to vote on the subject matter, shall be the act of the committee. The members present at a duly organized meeting may continue to transact business until adjournment, not- withstanding the withdrawal or abstention of enough members to leave less than a quorum. Study sessions may be conducted without a quorum with the understanding that no official action of the commitee would be taken at the study session. Section 3. If a committee member is unable to attend a meeting, that member is expected to notify the chairperson or staff of the Parks and Recreation Department. Section 4. The commitee has an obligation to be as clear and simple in its procedure as possible, and therefore should avoid, in voting, the finer points of parliamentary rules which may serve only to obscure the issues. ARTICLE 4. OFFICERS' DUTIES AND TERMS OF OFFICE Section 1. The officers of the committee shall be the chairperson and vice- . chairperson. Both shall be elected by a majority of the committee. Section 2. The chairperson's duties shall be as follows: a. Conduct committee meetings; b. Maintain contact with the Parks and Recreation Department director between m~etings; and c. Conduct correspondence on behalf of the committee. Section 3. The vice-chairperson's dutiei shall be as follows: a. Conduct committee meetings when the chairperson is absent; b. Fulfill other duties of the chairperson when the chairperson requests the vice-chairperson to do so; and c. Assume the unexpired term of. the chairperson should it become vacant. Section 4. The chairperson and vice-chairperson shall serve in those respective positions for one-year terms of office. ARTICLE 5. VACANCIES Vacancies on the committee shall be filled in the same manner as original appointments. A member so appointed shall serve for the unexpired term of the member whose position becomes vacant. ARTICLE 6. SUBCOMMITTEES The committee shall have the authority to appoint subcommittees as the need arises to make recommendations to the committee. The subcommittee may include persons who are not members of the committee, but at least one member of the subcommittee must be a member of the committee. ARTICLE 7. INTERNAL ORGANIZATION The committee may make and alter rules for its own conduct and procedures, consistent with State law and the city's charter, ordinances,. resolutions, and policies. ARTICLE 8. AMENDMENTS A majority of the committee may amend these bylaws at a regular meeting, provided the committee discussed the amendment at the preceeding regular meeting, or the staff sent a copy of the proposed amendment to all com- mittee members at least two weeks prior to the regular meeting at whice action is to occur.
