Amendment to Park Rule 1.007
Enclosed is the original of an Administrative Order amending
Park Rule 1.007 we have prepared at the request of the Police
Department.
This amendment accomplishes two things: (1) it prohibits
possession as well as consumption of alcoholic liquor and malt
beverages in the specified park areas, and (2) language similar
to that in the motor vehicle code for open containers has been
added.
We believe these amendments clarify the original intent of
the rule and will eliminate some of the enforcement problems
currently being experienced.
If you have any questions, please contact either myself or
Sgt. Greg Zahar with the Police Department. If the Order as
drafted meets with your approval, I would appreciate receiving a
copy after it has been signed and filed with the City Recorder.

AMENDING PARK RULE 1.007
The Executive Director of the Parks, Recreation and eultural
Services Department (PAReS) of the eity of Eugene finds that:
A. Under the provisions of Park Rule 1.007, the
consumption of malt beverages and alcoholic liquor, other than
hard liquor, is permitted in all park areas except those set
forth in subparagraphs (a) to (h) of Rule 1.007.
B. In order to effectively enforce the purpose and intent
of Rule 1.007, it should be amended to provide that possession of
any receptacle containing any alcoholic liquor which has been
opened or had the seal broken is also permitted in park areas,
except those set forth in subparagraphs (a) to (h) of Rule 1.007.
NOW, THEREFORE,
The Executive Director of the PARes Department of the eity
of Eugene orders and directs that:
section 1. Based upon the above findings, and pursuant to
the authority contained in section 2.812 et sea of the Eugene
Code, 1971, Park Rule 1.007 as amended herein, is hereby adopted:

POSSESSION OR eONSUMPTION OF MALT BEVERAGES
AND ALeOHOLIe LIQUOR.
Consumption of hard liquor, or possession of
any receptacle containing any hard liquor is prohibited
ln all park areas. Possession of any receptacle
containing alcoholic liquor or a malt beverage which
has been opened or had the seal broken or the contents
of which have been partially removed, or consumption of
malt beverages and alcoholic liquor is permitted in all
park areas except within:
(a) Children's playground areas;
(b) Athletic fields;
(c) Wading pools;
(d) Swimming pools;
(e) Tennis courts;
(f) Parking lots;
(g) Rest rooms; and
(h) The following specific areas:
1. Alton Baker Park: Prohibited
throughout, except for the picnic shelters;
2. Amazon Park: Prohibited within the
Amazon Center, except by special

authorization;

Prohibited except at the discretion of the
Center Supervisor;
4. eharnel Mulligan: Prohibited
throughout;
5. Hendricks Park: Prohibited within
the Rhododendron Garden section;
6. Lamb eottage: Prohibited within
the building or wi thin 200 feet of the
building, except by special authorization;
7. Laurelwood Golf eourse: Prohibited
except at the discretion of the Course
Operator;
8. Monroe Park: Prohibited
throughout;
9. Owen Memorial Rose Garden:
Prohibited within the Rose Garden section of
the park;
10. Park Offices: Prohibi ted wi thin
all administrative offices or the Park
Services Complex at 210 Cheshire Street;
11. Petersen Park Barn Community eenter
and Park: Prohibi ted within the Center
except by special authorization;

23. Willamette River Greenway Park and
River House: (Described as that contiguous

park land west of Owen Rose Garden to a point
on the west boundary where the improved area
ends and the natural river front zone begins)
- Prohibited throughout.
For purposes of this Rule, the definitions contained in
Section 4.105 of the Eugene Code, 1971 for malt
beverage, alcoholic liquor, and 'hard liquor, shall
apply.
section 2. In addition to the findings set forth above, the
Executive Director of the PARCS Department specifically finds and
declares that the Park Rule amendment contained herein is
necessary for the preservation of the welfare and safety of the
citizens of the City of Eugene. Failure to promptly adopt the
revised Rule will result in serious prejudice to the public
interest and continue the enforcement problems currently being
experienced. Therefore, an emergency is hereby declared to
exist, and Park Rule 1.007, as amended herein, shall be effective
on and after the date a certified copy hereof is filed with the
City Recorder of the City of Eugene, which date is indicated
below.
