Oregon DELEGATING RULE MAKING AUTHORITY TO THE EXECUTIVE DIRECTOR OF THE LIBRARY, RECREATION & CULTURAL SERVICES DEPARTMENT. The City Manager of the City of Eugene finds that: A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 1976, the City Manager is designated as the administrative head of the City, and is speci fi ca 11 y authori zed to appoi nt and remove all employees (except as otherwi se provided in the Charter). organize, disband. or reorganize City departments, and to enforce all ordinances of the City. B. Subsection 2.019(1)(h) of the Eugene Code, 1971 authorizes the City Manager or designee to adopt rules for implementation of any provisions of the Eugene Code, 1971. Under Subsection 2.1990(2) of that Code, violation of such a rule regulating city parks, recreation or cultural facilities or programs, or other public buildings and facilities owned by the City (including, but not limited to. City Hall, the library, and the Hult Center) is punishable by a fine not to exceed $500 or confinement in jail not to exceed 30 days. or both such fine and imprisonment. C. Rules currently need to be promulgated and/or revised for use of the City Library. Hult Center, and other recreation or cultural facilities or programs. and it would be more efficient to delegate my rule making authority for the City library. recreation facilities and programs, and City cultural facilities and services to the Executive Director of the Library, Recreation & Cultural Services Department (LRCS). Now. therefore. based upon the above findings, which are hereby adopted. The City Manager of the City of Eugene orders and directs that: 1. The Executive Director of the City's Library, Recreation & Cultural Services Department (LRCS) is hereby authorized to adopt rules for the City Library. recreation facilities and programs. and City cultural facilities and programs, in the manner set forth in Section 2.019 of the Eugene Code. 1971. 2. The prior delegation of authority to the Executive Director of LRCS to enforce applicable provisions of the Park Rules, as set forth in Administrative Order No. 58-94-12 is hereby affirmed.
