HomeMy WebLinkAboutOrdinance No. 18945ORDINANCE NOr l$945 AN ORDINANCE CO~~CERNING ANIMAL CONTROL; AMEND- ING SECTIONS 4.355, 4.375, 4.3$0, 4.4Q0, AND 4.4Q5 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN A5 FOLLOWS: Section 1. The caption and def initiot~ of "Abandoned dog" as contained in Section 4.355 of the Eugene Code, 1971, are hereby amended, and a new definition for "Animal" is hereby added in alphabetical order therein, all to read and provide: 4..355 Animal Control - Definitions. For purposes of sections 4.355 to 4.450 of this chapter, the following words and phrases shall mean: Abandoned as a transitive verb with an animal as its object means: ~a} To leave for more than ~4 hours without food and water or needed medical care; fib} To leave a barking dog for more than ~4 hours without supervision; or ~c} To fail to reclaim within 24 hours after receiving official notice of imprisonment of the animal. Animal. A non-human animate being capable of voluntary motion and of rapid motor response to stimu- lation. Section 2. Subsection ~.l} ~a} , and the dog license fees for unneutered, neutered, and owners 65 years of age or older contained in Subsection ~3} of Section 4.375 of the Eugene Code, 19?1, are hereby amended to read and provide: 4.375 Licenses, Fees and E~ce~,tions . ~ 1 } Dag licenses . ~a} Every owner of a dog which has a set of per- manent canine teeth or has attained the age of sip ~6} months, whichever event occurs first, shall immediately obtain a license for the dog, (3) Dog License Fee - Unneutered Fee $ 5.OQ Dog License Fee - ~~eutered Fee . $ ~.a4 Dog License Fee - Owners 65 years of age or older . . . . $ 2. Section 4.380 of the Eugene Code, 19?l, is hereby amended to read and provide: 4.380 Abandoned Animals. ~l} Na person in charge of an animal may abandon the animal, and no owner of an animal may allow it to be abandoned. ~~} Any peace officer or dog control officer, upon finding an abandoned animal not impounded by the dog control authority, may: ~a} Provide food and water and arrange for needed medical service far the animal at the cost of the owner or person in charge of the animal. The owner or person in charge of the animal shall pay for such services; or, ~_b} Impound the animal. As soon as practical, notice of impoundment under this section shall be posted at the house or an the structure where the animal was found or be mailed to the owner or person in charge, of if the owner or person in charge is unknown, to the address at which the animal was found and impounded. Section 4 . The caption, and subsections ~ 2 } and ~ 3 } of Section 4.40D of the Eugene Cade, 19'1., are hereby amended to read and pra- vide.: 4.400 Impoundin Re ulations and Disposition of Impounded Animals. ~ ~ } Except as .provided in section ~ 1 } ~ a } , the dog con- trol authority shall notify the owner by telephone or by the mailing of an impoundment notice as soon as practicable after impoundment. The impoundment notice shall advise the owner of the place where the animal is kept, the procedures required .for the redemption of the animal, the fees for the impoundment, daily care and redemption, and the consequences of failure to redeem the animal. ~3} A dog owner whose dog is impounded under sections 4.410 and 4.435 of this code, within the time described in sec- tions ~l} ~a} ar ~l} ~.b} , whichever is applicable, believing to have been aggrieved by the seizure and impounding of the dog, may apply to the municipal judge for release of the dog, and the municipal judge shah, thereupon set a time and place for hearing the application and notify the impounding officer, and. upon a summary hearing the municipal judge shall have full power to determine whether the dog has been wrongfully im- pounded, whether it shall be returned to its owner, and upon what terms and whether it should be humanely destroyed and the cost of impoundment, care and destruction assessed to the owner of the dog. Ordinance - ~ 18945 Section 5. Section 4.405 of the Eugene Code, 1971, is hereby amended to read and provide: 4.4 0 5 Impoundment ~- Redem tian and Sale . ~l~ Redemption of an impounded animal shall be made by exhibiting satisfactory proof of ownership and by paying the following required fees and charges: ~a ~ Impoundment fee ; ~.b~ Daily care fee; ~.c~ Z,icense and rabies vaccination fees, if required; and Qd} Medical care fees, if required. ~2~ 2mpounded animals may be sold or released to another governmental agency charged with the regulations management or care of the animal specie. ~3~ when an animal is sold by the dog control auth- ority, the purchaser shall pay any required license and rabies vaccination fees, ~4~ ~~o impoundment charge shall be made for an animal released after the municipal court's determination that no violation occurred. ~5} ~o live dog sha11 be sold by the dog control auth- ority far surgical or medical, demonstration or vivisection. ~6} Except as otherwise provided, if after 12D hours an impounded animal cannot be sold, the dog control authority is authorized and empowered to destroy the animal by any humane method permitted under state law ar this code. Section 6. That the matters contained herein concern the public welfare and safety and therefore, an emergency is hereby declared to exists and this .ordinance sha11 become effective immediately upon its passage by the City Council and approval, by the Mayor.
