RECITALS:
The City Council of the City of Eugene dad by Resolution No. 3193, adopted July 18, 1979 and 3543,
adapted July 22, 19$1, determine to pave streets and construct sanitary sewer, storm sewer
and pedestrian way within and adjacent to Treehouse PUD; sanitary sewer on Frederick Court fr
. 35th Place to 450 feet west; and paving Dellwood Drive from 450 feet northwest of 38th Avenue
to 650 feet northwest of 38th Avenue; and storm sewer between Dellwood Drive and 38th Avenue
to serve Lat 10, Block 2, Clayton Hi11s Subdivision, and Lois 53 and 54 of Treehouse Subdivis
The City Council authorized the execution of a contract for the construction of the local
improvements an Au ust 14 , 19 79 ;, and August 10, 1981;
The 1 ocal improvements. have been constructed in accordance with the contract and applicable '
.. provisions of the Eugene City Code and the cost thereof and amount to be assessed have been ascertained to be:

The City Counci] has established the method of calculating local
improvement assessments in Sections 7,17Q through 1.180 of the Eugene City
.
Code; and
(Notice of the proposed assessment to the owners and reputed owners
of the hereinafter designated parcels of real property has been heretofore duly
and regularly given in compliance with the provisions of Chapter 7 of the
Eugene City Code, and the City Council has heard any and all protests,
objections and remonstrances thereto and has fully considered them.
THE CITY OF EUCE~~E DOES ORDAIN AS FOLLOWS:
Section 1. That the total cast of paving streets and constructing sanitary
sewer, storm sewer and pedestrian way within and adjacent to Treehouse PUD; sanitary sew
on Frederick Court from 35th Place to 45O feet west; and paving Dellwood~Drive from
450 feet northwest of 38th Avenue to 650 feet northwest of 38th Avenue; and storm sewer
between Dellwood Drive and 38th Avenue to serve Lot lO, Slock 2, Clayton Hiils
Subdivision, and Lots 53 and 54 of Treehouse Subdivision
in the City of Eugene, is the sum of ~ 528,863.77 , aforesaid, which
is by this ordinance assessed against the parcels of property hereinafter
described in the amounts set apposite, respectively.
Section 2. That the City Council of the City of Eugene, Oregon,
does hereby determine and assess each lot and part of lot being in Eugene,
sane County, Oregon, to-wit:

5ection~ 3. That the City Council of the City of C~gone dogs
hereby determine that each parcel of land or lot hereinbefore described
~is specifically benefitted to the extent of the assessment hereinbefore
set forth, and does hereby declare each and all of said assessments to
be liens upon the respective tats, parts of fats or parcels of land
against which said several amounts are assessed, and orders and directs
the City Recorder to enter in the Jacket of City liens, a statement thereof
containing the fallowing;
first: A description of each lot, part of lot ar acreage properly
liable for such improvement.
Second: The name of the owner or reputed owner thereof, ar that
the name of the owner is unicnawn.
Third: The sum assessed upon said property and the date of entering
the same in the said docket of City liens.
Section 4. That these provisions concern the public welfare
because of the necessity to promptly record and ascertain the amount of
each assessment and the lien arising therefrom, and the need to promptly
notify affected property owners, and therefore an emergency is hereby
declared to exist, and this ordinance shall become effective immediately
upon its passage by the Council and approval by the Mayor.
