AN ORDINANCE AUTHORISING THE INSTITUTION OF PRO-
CEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION
BY CONDEMNATION OF PROPERTY INTERESTS AND EASE-
~~.ENTS FOR THE PURPOSES OF THE LOCATION AND CON-
STRUCTION OF THE OWOSSO BICYCLE/PEDESTRIAN
BRIDGE AND RELATED PUBLIC UTILITIES BETWEEN THE
EXISTING WILLAKEIri~IE PUMP STATION AND THE
REGIONAL SEWAGE TREATMENT PLAINT; A~1D DECLARING
AN EMERGENCY.
The City Council of the City of Eugene finds that:
The City has authority under provisions of the City Charter
and applicable state law to institute proceedings in eminent domain
for the acquisition by condemnation of private property for public
purposes, including the construction of bicycle/pedestrian ways and
public utilities.
The City of Eugene is in the process of improving bicycle/pedes--
trian ways within the City in order to provide for the safe and effi-
dent movement of bicyclists and pedestrians. The proposed Owosso
Bridge construction is in compliance with and in furtherance of the
City's duly adopted Master Bicycle Plan.
Necessary public utilities such as electrical lines, telephone
lines, cable television lines, and sewer facilities can be located
within the area sought for construction of the bicycle/pedestrian
bridge and access for emergency vehicles provided, and it is in the
best public interest that provision therefor be made.
The location and construction of the Owosso Bridge across the
Willamette River between the existing Willakenzie Pump Station and
the Regional Sewage Treatment Plant necessitates the acquisition by
the City of fee simple title and/or permanent easements, together

with temporary construction easements to portions of the parcels
of real property as shown on the attached Exhibit "A", or such
other locations thereon as may, in the City's judgment, constitute
the most beneficial and practical location for the improvements.
The proposed improvements are in compliance with and in further-
ance of the plans and specifications prepared by the City Engineer
at the Council's direction and in accordance with the provisions of
the Eugene Code, 1971, and applicable policies and agreements of the
City of Eugene. Now, therefore,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Based upon the above findings, the City Council of
the City of Eugene does hereby find, declare, and determine it neces-
sary to acquire fee simple title and/or permanent easements, and tem-
porary construction easements to portions of the real property more
particularly shown on Exhibit °'A", which is attached hereto and in-
corporated herein by reference, or such other locations thereon as
may constitute the mast beneficial and practical location for the
improvements, in order to accomplish the location and construction
of the Owosso bicycle/pedestrian bridge, public utilities, and to
provide emergency vehicle access. That the above improvements are
in accordance with the plans prepared by the City of Eugene Depart-
ment of Public Works and approved by the City 'tanager.
Section 2. The City Council does hereby direct that the City
of Eugene shall institute proceedings in eminent domain for the con-
demnation of the above described interests in real property, and,
at least 2Q days prior to the filing of any action for condemnation
