TAx IN CONNECTION CENTER; ADDING EUGENE CODE, 1971: ODE; REPEALING DECLARING AN THE CITY OF EUGENE DOES ORDAIN AS FQLLQwS: Section 1. The following heading and sections are hereby added to the Eugene Cade, 1971, to read and provide as follows: EUGENE PERFORMING ARTS CENTER - PATRON USER FEE 3.814 Eugene Performing Arts Center Patron User Fee. ~l} For purposes of this section, the following words and phrases mean: Admission fee. The dollar amount charged, whether or not received, for entry to an event. Event. A performance, presentation, demonstration, exhibition, or meeting at the Eugene Performing Arts Center to which the public is invited. Person. As defined in subsection fie} of section 3.770 of this chapter. ~2} For the privilege of attending an event there is hereby added to the admission fee for each attendee a patron user fee of $0.25. The patron user fee shall be: ~.a} collected at the time the admission fee is paid, ~.b} in addition to the admission fee, and ~.c} separately stated on any receipt for the admission fee. 3.812 Eugene Performin. Arts Center Patron User Fee - Admin- istration and Collection. ~l} Collection of admission fees and patron user fees far all events shall be under the direction and control of the city manager. The city manager may contract with persons to collect admission fees and patron user fees. The city manager may adopt rules and regulations to insure all fees are collect- ed. The rules and regulations may provide for the payment of the fees by the use of credit cards. ~2} The city manager or his or her designate shall de- posit all patron user fees collected pursuant to section 3.810 in the Performing Arts Unearned Income Fund. ~3} No official or employee of the city may disclose any information regarding the business of a person required to Ordinance - 1 18961 pay or collect the patron user fee prescribed in section 3.810, except that nothing in this subsection shall prevent: ~a} The disclosure to, or the examination of records and equipment by a city official, employee, or agent for the sale purpose of administering, collecting, or auditing the patron user fee; fib} The disclosure of general statistics re- garding taxes col~.ected or business done in the city; or {_c} The disclosure of information necessary to enforce the provisions of sections 3.810 and 3.81.2. Section 2, Section 3.990 of the Eugene Code, 1971, is hereby amended to read and provide: 3.990 Penalties - 5 ecific. {l} Violation of section 3.D1D is punishable by fine not less than $50.D4 but not to exceed $540.40. {2} Any person who fails to pay a tax as required by section 3.700 of this code may be fined $50.00 per day so long as the failure continues. {3} Engaging in an activity for which a license has been revoked or suspended is punishable by fine not to exceed $500.00, or confinement in jail, not to exceed 100 days, ar both fine and imprisonment. {.4 } Violation of sections 3.314 to 3.319 , 3.715 and 3.412 is punishable by a fine not to exceed $500 or confine- ment in jail not to exceed 100 days, or both fine and imprison- ment. Section 3. Section 3.996 of the Eugene Code, 1971, is hereby repealed. Section 4. That the matters contained herein concern the public welfare and safety and therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
